Tuesday afternoon Judge Adams banded eltivvn an opinion in the suit of the Centaur Company, of New York City, against Samuel V. Eslinger, of St. Louis, the suit being for an injunction to re strain the defendant from using the plaintiff's remedy, "Castoria." It was stated in complainant's bill that the Centaur Company, of which Charles II. Fletcher is president, is the sole manufacturer of "Caatorio." and alleged that the defendant had been clli ng meelieine in packages closely resembling those of the New York firm. A preliminary injunction was prayetl for to restrain th defendants from in any way pirating upon the complainant's business. The bill averred that the damages unstained were large, but could not be estimated. The plea of the defendant was that he had a right to do as he hat! done. K idence in the case was taken by affidav its. Judge Adams, withenit leavInir the bench, delivered an opinion in whie h he denounced imitators of wellknown medicines. He said the practice was a species of robbrry and he would grant the injunction sought. The medicine "Castoria" was at first protected by patent nnd later by label and trade mark. The plaintiff claimed lhat other decisions similar to the one handed down yesterday have been secured in the Federal courts, cases being innumerable in Chicago, Indianapolis, District of Columbia.
