Whether it was sufficient to warrant a verdict of guilty was a question for the jury under the instruction of -the court. The learned judge mingled tbe duty of the court and jury, leaving to tbe jury do discretion but to obey tbe directions of the court. When there Is no evidence, or such a deficit in it tbat the law will not permit a verdict for tbe plaintiff to be given, such an instruction may be prop erly demanded, and itistheduty of the court tor'veit.
