The original opinion in this case (reported June 28) is adhered to, save ts it may be modified in this opinion. The record shows thst this suit was commenced, prosecuted and finally tried under and in accerdsnce with the provisions of the amended sections 65 and 68 of tha d •cedents* route, act, aa they were at tempted to be amended by the act of February 20,1855. The record also shows that the original complaint in this case waa placed upon the issue docket as a civil action, and not aa a claim, lor issue and trial. After process had been served on the administratrix of Albert G. Sloe, deceased, she appeared and moved to strike the cause from the docket which motion was anetoined. That was an end of the case, and Hcoaid not be a pending suit or claim against the decedent’s route, undeg .aay law in force, until renewed and eenftneneed ugatu in aotne form.
