notes remain unpaid. Sec. 53. All laws and parts of laws conflicting with this act are hereby re pealed. Sec. 51. Each bank organized under the provisions of this net, and each bank now in existence instituted tinder Ihe provisions of said amended act, shall, upon its compliance with the provisions ot this act, appoint an acretit. who shall keep an office in the city of Indianapolis for the redemption of the circulating notes of such bank, either in coin or exchange upon the city of .New York, at the option of such bank: Provided, hovever, that such circulating notes may be redeemed at such agency, if in coin, at a rate of discount not exceeding one per cent., and if in exehange, at a rate not exceeding ihe curreut rate .of exchange at the time upon New York. Such agent hall be appointed in writing, a certificate of which shrll be filed in said banking department, which shall cause a list of the agents appointed under this act to be published m one of the daily newsEapers of the city of Indianapolis. ach bank whose ageat shall for the space of ten days refuse to redeem its notes, as aforesaid, may be proceeded against by the banking department, upon protest, in the same manner as herein provided, upon a refusal to pay coin at the bank. Sec. 55. The Auditor of State shall give bond with security, in tho sum of twenty-five thousand dollars, and the Treasurer of State hall give bond, with security, in the sum of fifty thousand dollars, payable to the State of Indiana, conditioned for tlio faithful performance of their respective duties under this act; which bonds and security hall be approved by the Governor, and his approval shall then be placed by him in the office of Secretary of State, who shall file and deposite them in his office: and suit may be brought thereon for the uso of any persons, or banking association which may be injured by and breach of duty on the part of said Auditor or Treasur-' cr, in relation to any duties required of them respectively by this act. The Auditor shall receive a salary of fifteen huudred dollarsand the Treasurer of State shall receive eight huudred dollars salary in addition to all other fees and salaries for the performance of all the duties required of them by this act, which salaries shall be paid out of the Stato Trcasnrv, by the banks in the form of a feo of one cent on each bill for circulation signed by tho Auditor; ri nd ifaid fees does not amount to a sum sufficient to repay the same, tho residue shall be apportioned equally amongst the banks, aud retained out of their interest on their bonds, unlefs otherwise paid by the respective banks upon being duly informed of the amount thereof. Sec. 66. Inasmuch as the present General Banking law of stlm Slate is insufFcient to afford the people a sound circulating medium, an emergency exists for the immediate taking effect from and after passage. Tho alarm that was caused by the hard t!mes, which was resulting in causing many papers to suspend entirely, and sell out. and which caused many old and established papers to reduce their dimensions, deterred us from making; the enlargement we had contemplated, at the beginning ol the volumn. Tkough thwartod, for the time being, we still kept our purpose in Tiew, and now present the patrons and borrowers of tho Americas, The Largest Paper in Indiana. And.'if it U net tho lest paper, it shall not be for want of unceasing application to ita interests, on the part of its editor. When we took charge of the American, somo sixteen months ago, it was not without many a fear that we would not bo able to retain its large subscription iist. Out this has constantly increased, notwithstanding the discouraging circumtances of the past year, and we now have a circulation that justifies the eipcnditure we have mado in enlarging. In addition to the embarrassment which grew out of our want of experience as an editor, we were somewhat alarmed at the fears of many personal friends. They thought it impossible for us to succeed, unless wo should consent to become the Organ of some party. Out having long ago settled in our mind that parties will become corrupt, aud that they are usually kept in ex istenco (or the benefiit of a few aspirants, we determined to pursuo our chosen course, and fail, if fail we must, in attempting to cubliah a paper that should be truly independent. The readers of tho American know full well, that we do not m can by being independent, that we will not take sides for or against the question at issue. It has not been hard to tell on which side of any question we havo been, nor shall If be in future. We mean to say, that no caucus or convention, no wis warn or council, or tribe, shall dictate what we may say or may not say. We know everybody knows, that a paper that sells itself to party, must leave unreprovedthe political blunders or dishonesties of its party, and distort and misrepresent the acts of its opponeuts. We hare certainly tried to avoid these errors, and shall continue to try io. future. How far we have succeeded , we leave with our candid, constant readers.
