The Sew Liquor law. The State Sentinel gives the following sjnops.8 of the new liquor law which liaa just passed both Houses of the Legislature. It will meet with the universal approbation of the people, but therb ' are some intimations that the Governor will veto it: As there is a general anxiety to be informed of the provisions of the act which has passed both branches of the Legislature, regulating the traffic in drinking beverages in tho State of Indiana, we give below a 8vi)oKis of the material portions as adopted after its reference to the joint Committee of Conference. The act has not jet received the Executive approval. The first section provides u that no . per
son shall sell or barter, either directly or indirectly, any spirituous, vinous, mult or iu. toxicating liquors, by a less quantity than oiwgallou ata time, withiu this State, without tirst procuring from the Board of Com missioners of the county iu which stub iquors are to be sold, a license." , ' Section second requires that any white male inhabitant desiring to procure a license, shall give no'tice of his intention to upply fur the same ly publishing n notice iu a weekly pajier, and if no paper is published, by posting throe notices in the most con spicuous places iu the township where he in tends to sell, twenty days before the itiectng of the Board, stating the precise location of the premises where he desires to sell, ami any inhabitant has thu privilege of remonstrating iu writing agaiust the granting of the license to any applicant, on account ot in morality or unfitness. Section third confers upon the County Commissioners power to grant licenses upon the conditions that the required notice hau been given by the applicant ; that he is a man ot good moral character, and fit to be trusted with said business, and upon his giv ing bond with at least four freehold sureties of said township, to be approved by the County Auditor, in the sum of $2,000, con ditioned that he will keep an orderly and eaceable house, and that he will pay fines and costs assessed against him for any viti ation of this act, and to pay all damages and costs that may accrue under the provis ions of this act, tnvmir the riirht of action othe wife, child, or other person injured by the sale of liquor. Section four requires tnat each applicant shall pay the treasury of the county, before icense is granted, not less than !20 nor more than $1,000, to be determined by the county Commissioners, as a fee for license for one year any amount paid for license toauy incorporated towu or city to be de ducted therefrom aud all licenses collected by auy authority, to he paid into Common School rund in the county where paid. Section five provides the manner ot issung license by the County Auditor. Section six provides that no license shall issue tor a greater or less term than one -ear. Section seven declares that the license under this act shall not authorize any to sell or barter any spirituous, vinous, malt or other liquors ou Sunday, to any minor, to an intoxicated person, or on the day of any State, county, township or municipal elec tion in I lie township or city where the same ic uolden. Section eight provides for the collection of i fine of not less than $5 nor more tuau $50 for each offense for selling to any jierson in the habit of being intoxicated, after notice has been given to that effect. Section nine provides that any person not licensed who shall sell or barter any in toxicating liquors less than a gallon, to be drank on his premises, shall be fined in a sum not less than $5 nor more than $100 for each offunse, to which the court or jury may add imprisonment in the county j til not to exceed three months. Section ten provides the same penalties for selling or giving away intoxicating liquors to a minor or intoxicated person. Section eleven provides for a fine of not less than $50 or more than $500, to which may be added imprisonment in the county jail not over three months, for adulterating intoxicating liquors intended tor sale, or tor selling adulterated liquors. Section twelve provides that every place where intoxicating liquors are sold or giveu away, if kept in a disorderly manner, aud every house or place wherein any drugged, poisoned or impure liquors, or liquors mixed with any poisonous or deleterious tsulistances are kept to lie sold or given away, shall be deemed common nuisances, and the keeper thereof shall be fined not less than $50 nor more than $200, to which may be added imprisonment for not exceeding three months; but this section not to take effect front the time ot the passage of this act until the next meeting ot the County Commis sioners thereafter. In section thirteen, the Courts of Common Pleas and the Circuit Courts within their respective jurisdictions to have concurrent jurisdiction for the violation ot this act, and tt is made the duty of errand mrors to take cognizance of such offenses. Section fourteen gives Justices of Peace Jurisdiction to try causes under this act, pro viding that iu the opinion of the Justice or Jury trying the case, it a fine ot $25 is not sufficient, the party offending to be bound over to a Court having competent jurisdic tion. Section fifteen permits druggists to sell intoxicating liquors in less quantities than a allon, for medicinal purposes, and "nothing contained in this act shall be so construed as to prohibit the sale in any quantity by the manufacturers of wine aud cider, from fruits grown by the mau u fact uri-r or any other person within this Sate, provided that the aforesaid manufacturer shall not sell such wine or cider to be drank, or suffer the saru to be drank in his house, outhouse, yard or garden, or on any of his premises." Section sixteen makes it the duty of the proper district or city attorney, when informed, to immediately prosecute violations of the act, and upon failure, any other attorney or citizen is authorized to prosecute suit. Sections seventeen and eighteen repeals all former acts in conflict with this, and provides for its immediate taking effect upon publication in Sentinel and Journal. ßS-The Hannibal, Mo., Messenger, of the 'etb, informs ua that? A. J. Bird, a wellknown citizen of Rail connty, where he had numerous relatives, was murdered a few days ago by a young man named Smith, who fired a load of small shot through his abdomen. The provocation that lead young Smith to the commission of the act was the practice hy A. Jay Bird of stealing small quantities of corn from the field of Smith's father.
