I have examined the question presented by the ordinance providing for the improvement of Virginia aveaae, and respectfully snbmit the following opinion: The Connell can not compel the property owners to pay for the raisingpf the •treet railway track, nor for any extra expense caused by relaying said track. The only assessment that can be legally made against the property owners is for the expense of Improving the street. I gave your honorable body an opinion, some months ago, that the city was not legally liable to pay the expense of relaying or raising street railway tracks. Upon consultation with the Judiciary Committee, I found that they entertained a different opinion. I again examined the question, and am constrained to adhere to my former opinion. Mid with all deference to hold an opinion different from that entertained by the Judiciary Committee. The Committee and myself are united in the opinion that the property owners can not, in any event, be taxed with the expense of ratoing or relaying the track. I respectfully suggest that the ordinance provide that the ex the track be. in the flrst instance, paid by the city, and by the city collected of the railway company. This will obviate all questions as to the validity of the aseessment and enable the question to be properly tried between the railway company ana the city. Kespect folly, t B. K. Academy of Music.—The ever favorite piece of Fanchon the Cricket, was played at the Academy last night, with MUs Ada Webb in the title role, and a very fair audience in the bouse. The piece has been played here time aud again by all the stars In that line of buainess, from Maggie Mitchell down, but it was* never played belter than last night. Mias Webb is a charming actress, and in the years that have elapeed since her laet appearance here, has developed and improved beyond the most sanguine expectation. Her Impereonatlon of Fanchon was decidedly good, especially in the second and third acta, where her aeting waa strikingly natural. The onlytoalt which canid be found with her wna that she dressed the part a little too well, bat that is excusable, for the public seems to require now-a-days that stare shall wear good clothes, no matter wbat characters

Further Particttlaiui of the Storm.—The account of tho storm and its ravages which appeared in the Sextixel yesterday morning, waa in the main correct, although of course it was impossible at that early honr to learn of all the damage inflicted. And even yet the lorn in thia city can not be determined, for there was very mnch damage done in the way of blowing down fences, trees, etc., Of which no account will be taken. The Western tbiion Telegraph Company will probably lose a good deal from the blowing down of polea and breaking of wire. On the Jeffersonville road the poles were thrown down for a distance of nearly six miles, and on the other lines there were

many more.

The whirlwind seems to have been confined to thia particular locality, for we oonld bear nothing of it beyond the city limits on the south and the Fair Grounds on the north. There were two currents, the one, the coarse of which we traced last night, passing throngh the heart of the city, exhausted its force in the campus ofthe Northwestern Christian University, the other', at the western side of the city, first struck the Indianapolis Cotton Mill and the flooring mill of 8ohl, Gibson A Co., tearing off a portion of the roof of each, and then passing across the city to the northeast, left ita mark in the old 1 inker orchard, better known as Camp Burnside, where it uprooted a dozen large trees, cutting a clean swath. Then on to the fair grounds, where, first playfully pushing over a dozen roils of heavy fence, It revealed Us power to the fullest extent in the complete destruction of Mechanic’s Hall. This was a large wooden bnllding, thirty by two hundred feet, firmly set upon stone piers, with posts rnnning into the ground, but the wind tossed it abont as easily aa if it had been an old shoe. From the appearance of the ruin, we should think that it had been raised clear up, and then dropped down It is a complete wreck, and is no broken up and injured that the material would hardly pay for iu removal. A large, sound, hickory tree, standfng at the side of the building, was snapped eff as though it had been a pipe stem. The bnllding was put up laat summer, and cost between fifteen and eighteen hundred dollars. It was one of the most elegant and durable upon the grounds, and its loss will corns rather severely on the Board of Agriculture, who are about to erect additional bnildings. Heveral fine trees waa also torn up in thogronnds, and at the Eastern end a good deal of fencing was overturned. The Mechanical Hall Is even more of a ruin than the Central depot, a fact which may give onr readers some Idea of the strength of the wind. On Fort Wayne avenue at the corner of Alabama street, the unfinished brick walls of a grocery were blown partly down, and In the southern part of town, anfonoocupied brick bouse waa entirely destroyed. On Madison avenae a frame boose was considerably injured, a portion of the slate roof of the Trinity M. E. Church was blown off and In the campus ot the N. W. C. Unlvereity, a number of fine forest trees were torn up. Nearly all the freight In the Central Depot was removed yesterday, having been uninjured by the foil, althongh damaged by rain. The loss of the building is estimated at 110,000; that of J. P. Evans * Co. 98,000, most of which is due to the wetting of flax seed; that at the cotton mill at $1,500; at the fair grounds $3,000| Sohl, Gibson A Co.’s., $600; .Sinker’s foundry, $000; Cincinnati depot, $;i00. Tlis total loss will not fall far short of

$40,000. •

The Faik Orousds.—in company with (he .Superinteniient, John B. Sullivan, Esq., we visited the fair grounds yesterday. The work of putting up the new buildings, making repairs, etc., will be commenced as soon as the weather will permit, and at this time the gronnds are being cleared up as much aa possible. Tbs old floral hall, in the trotting ring, will be torn down thin season, and a large and elegant ball erected Just east of fine' art hall. The mechanical hall, blown down night before last, will probably be rebuilt In the same plaoe, while on a line

While on the subject of billiards it will not be ont of place to mention that John McDevitt, of Chicago, formerly of this city, has challenged the champion of the billiard tournament, soon to be held in New York city, and has gone there to look after his interests in the projected match. He proposes to visit Indianapolis on his route homeward, for the purpose of giving his numerous friends and admirers an exhibition of hi* skill. Becaoa* a maa happens to be published aa paying tax upon a small amount, it ia not certain that ho had a small Income, nor does it follow that ha has defrauded the Gov=_ ernment by nuking n false return. Besides the usual deductions for rent, living, taxes, repairs, interest, etc., dividends of National banks, and perhaps other corporations sre deducted from the taxable income, because a tax la levied when the dividends are declared. For this reason some of onr citizens who, in reality pay tax upon large smns, are pubHahed as paying but little. Were tb# real ineomes published, and not those npon which a tax is levied after all deduetions have been made, the list would present an entirely different appearance.
