They will be re-assembled, however, without unnecesary delay, and I do not doubt, will notify to you the time when they will be prepared to meet the Committee of Investigation, and act with them in the investigation probably not later than some hour to-morrow. Silt: I have had the honor of receiving from you, personally, in my interview with tho Committee of Investigation, a resolution of the said committee, in the following words. "Ordered, That the President of the Bank of the United States be requested and required to submit to the Com. of Investigation the minute's books containing the proceedings of the Board of Directors of the Bank of the United States; the expense account and vouchers for expendi ture, under a resolution of the Board of the 30th of November, 1830." In answer to the requisition, I have the honor to State that I have not the custody of, nor control over, the books and papers mentioned in the resolution. The gene ral custody of the same is in the Board of Directors of tho Bank, who by resolu tions of the 24th and 28th tilt, already communicated tthe Committee of In vestigation, appointed a Committee of Di rectors, for the purpose of exhibiting these books and papers to the Com. of Invcsti gation,and declared they could not permit them to bo examined, except in tho pre eence of said Committee of Directors. At a meeting of Directors held at tho Bank, on the 6th day of May, 1834, the following resolutions were adopted. Resolved, That the Committee of the Board will bo prepared to receive the Committee of the House of Representatives, at the Banking house of the Bank of the United States, to-morrow morning, the 7h inst. at 1 1 o'clock, then and there to proceed in the execution of their duty according to the requirement of the charter, and in conformity with tho instructions of the Bond as contained in several

No. 39. May 7, 1834. Resolved. That the Committee will pro ceed to examine into the truth of thestatement made by the Government Directors o the President of the United btates and o Congress; and for that purpose will this day call for the production, for inspection of the minute books, containing the pro ceedings of the Directors of the Bank, and the expense books, and vouchers for expenses incurred. The Chairman of the Committee of the Board read to the Committee of Investiga tion the following preamble and resolution Whereas it appears from the resolution of the House of Representatives of the United Slates appointing the Committee of Investigation, that two distinct inqui ries were contemplated, one ot them directed to ascertain whether tho charter had been violated and limited to the acts of the corporation : and the other so very general and definite as to make it difficult if not impossible, to say whether it has any limits at all, either as to the matters to be inquired into or the mode of pursuing the inquiry: And whereas it appears, from calls made by tho Committee of Investi gation, that they have proposed a very wide range, embracing, among other things, an extensive examination of the acts, transactions, accounts, and letters of individuals, and thus instituting a kind of general search, which is the more objectionable, because, if it have any purpose at all, it must be to criminate those indi viduals as well as the liank; and if it have not this purpose it is without any as signable object, and would be an injurious invasion ol private interest: And where as, under these circumstances, it is the duty of the Committee by all lawful means, to protect the rights and sacred confidence entrusted to their keeping, and to yield nothing, bv consent, which cannot be 1 7 legally demanded from them: And where as, after careful and anxious consideration they are of opinion that the inquiry can only be rightfully extended to alleged vio lations ot the charter, and this inquiry ousht to be conducted according to some certain principles and rules: therefore, Resolved, That the Committee of In vestigation be respectfully required, when they ask for books and papers, to state specifically, in writing the purposes for which they are proposed to be inspected; and if it be to establish a violation of the charter, then to state specifically, in wri ting what are the alledged or supposed vio lations of the charter to which the evidence is alleged or supposed to be applicable. Resolved, That, in the opinion of this Committee, it would very much conduce to the purposes of justice, as well as to the convenience of all concerned, if the Committee of Investigation would furnish a specification of all the charges intend ed to be inquired into, and proceed with them in order as stated. No. 41 Whereas this committee have, by rcso' lutions severally communicated to the President and Directors of the Bank o the United States, declared that, in dis charging the duties confided to them by the House of Representatives, they claim ed on their responsibility to that House and to their constituents, to regulate their proceedings, to judge ot the extent of their powers and duties for themselves; tha they are not charged with the duty .1 r . t-v-criminating me lianK, us ui rectors, or others, but simply to inquire, amor other things, whether such prosecution, in legal form, shall be instituted ; and that, in so doing, they would atiord to every per son, who might appear to be implicated by their examinations, lull and lair opportu nity ot explanation and defence: Resolved, therefore, That in performing the duty of "inspecting the books and examining into the proceedings of the Bank, the Committee cannot rightfully be reqired," and from the nature of their duties cannot comply with the request, to state specifically in writing, the purposes for which they are proposed to be inspected. Resolved That the Committee cannot comply wi'.H a request or requisition to specify what are the supposed violations of the charter because they are not con ducting a prosecution, but inquiring whether one shall be instituted. Mr. Mason called for the production of the minuto books containing tho proceedings of the Board of Directors from the 1st of September 1832, to tho present date. 2. Tho chairman requires that the expense book of the Bank, with the vouchers showing the expenses of the Bank incurred under a resolution of the 30th November, 1S30, be submitted to the inspection of the Committee of Investigation. 3.
