upon all judgments against such insolvents as have heretofore been, or may hereafter be, relieved under the provisions of the acts which this act is intended to revive and amend; or under any other and former act of Congress for the relief of persons imprisoned for debts due to the United States." Provided, The District Attorney, of the district in which such judgments arc on record, shall certify that he is satisfied that the debtor is possessed or entitled to no property liable to be applied to the satisfaction of said judgments, and that the interest of the Govermcnt docs not require that such judgments should remain unsatisfied. Resolved, That tho President and Di rectors of the Bank be requested to furnish this Committee with a detailed state ment of all loans made since tho first of January, 1S29, to individuals, who then were, who have been since, or who now are, members of Congress, stating he amount of each loan, when the samo was made, for what term the security waskgiven, and the time when such security was received, and also the security which the Bank now holds, and the amount now ow ing by any and each of such borrowers, or any other persou3 for the benefit of such borrowers, at the Bank, or either of tho branches; and stating also the particulars of any such loans which have bcen protested, or which are now under protest, and the names of tho parties to any such debts, also the names (if any) of such persons whoso notes havo been renewed, with the names of individuals, parties to said renewals, whoso notes were under protest at the times such renewals were made by tho Directors or otherwise, and by what authority. Sir: I am directed by tho Committee of tho Board of Directors of the Bank of the United States, to acknowledge your letter of the 29th of April, and the copies enclosed with it of various resolutions of the Committee of the House of Represen tatives of the United States. The Committee deem it proper to lay your communication before the Board and would, for that purpose, have conven ed a special meeting before this time, bu' that it seemed to them necessary, r hrst, to collect certain materials of information for tho Board. This work they caused to be begun as soon as they could; it will be completed at the earliest moment possible, so as to be laid before the lioard to-mor row, after which, no time will be lo3t in communicating to you their decision.

They have been laid beoro the Committee and before the Board. The Committee this morning also laid before the Board your communication of he 29th ult.,andthe copies of resolutions accompanying it; and they have directed me to inform you, that as the resolutions of the 1st inst. will involve the necessity of a similar inquiry as those of the 29th ult., the Board do not deem it expedient to decide upon the one until they arc prepared to decide upon the other. Resolved, That the President and Di rectors of the Bank of the United States bo required to submit for the inspection of thi3 Committee, at their committee room at the North American Hotel, on Satur day the 3d day of May, inst. at 1 1 o'clock a. m., the book or books which contain the minutes of the proceedings of the Board of Directors, at their several sittings, on tho 1st and 8th days of October, in the year 1833, and from the 21st day of April 1834, to this day. Also, the report of a Committee of the Board, rejecting a proposition to transmi a copy of certain resolutions adopted on the 1st day of October, 1833, to the Sec retarv of the Treasury of the United im States ; also, the expense book of the Bank and the vouchers for expenses paid or in curred by said Bank, sinco tho 1st of Jan uary, 1832. Whereas this committee, sincerely desirous to conduct the inquiries, examinations, and investigations, which they have been required by tho House of Representivesto make, with fairness, impartiality, order, and despatch, have learned with regret that the Directors of the Bank of the United States have declined accommodating this committee with a room in their banking house, for the exclusive U30 and occupation of this Committee: Therefore, Resolved, That the sitting of this com mittee, shall be hld in their room at the North American Hotel, in the city of Phil adelphia, until otherwise ordered. Sir: I am directed by the Committee of the Board to acknowledge tho honor of your letter ot the 1st instant, covering . . sundry resolutions of the Committee of Investigation; and in reply to that letter, as well a3 in further reply to your letter of the 29th ult. to enclose to you a copy of the resolution of the Board of Direc tors of the Bank of the United States, at a special meeting convened this morning for the purpose of taking into consideration the several communications of the Committee of Investigation, not hereto fore answered. That the Board do not feel themselves at liberty to comply with the requirement of the resolutions of the Committee of Investigation of the 29th ultimo and 1st instant, and do sot think them selves bound to do so, inasmuch as in res pect to a part of the papers called for, the effect would be the same as the surrender of their books and papers to a secret and ex-parte examination, which they hare already refused to consent to; and as to the other part, they relate to matters over which the Board have no control: and if

they could overcome these objections, and had tho power over all the papers, still it

would be impossible for them to comply within any reasonable time, having ascer amed, by a careful examination that thecopies and statements, called for by th resolutions oi tne -:yth ult. alone, would require the uninterrupted labor of two clerks for at least ten months to raako hem out; and that the remaining resolu tions, so far as they concern matters not beyond the reach of the Board, would re quire great additional time, which they are notable exactly to compute, without causing what they fear would bean incon venient delay to the Committee of Inres igation; and they take it for granted that it would no more comport with the views of the Committee of Investigation to wait till so distant a period, than it would with the rights of the Bank, to have euch a burthen imposed upon it. States, ) 1 May 3, 1834.$ Sir: I am directed by the Committee of the Board to acknowledgo the honor of your letter of the 2d instant, covering copies of two resolutions ef the Committer of Investigation, and to inform you that a special meeting of the Board was called at tho earliest practicable hour this morn ing, that there might be no disappointment or delay to the committee of Investiga tion. The answer will be found in tho co pies of resolutions, herewith transmitted by order of tne Committee I have the honor to be, your most obe dient servant, JOHN SERGEANT, Ch'ia. The Hon. Francis Thomas, ChVn. Com. of Investigation. No. 30. Enclosed in the foregoing. Resolved, That the Board are not e ware of having declined to accommodate the Committee of Investigation with tho exclusive use and possession of a room in the banking house, unless the Committer of Investigation so construe the early and ready offer of the room by the Board witk the assertion of the right of the Committee of the Board to be present at the ex amination and investigation of the books and papers of the Bank, and to have th care and custody of the same; and if such be the meaning of the Committee of Investigation, then the Board are constrained to adhere to the ground, as they think of manifest right, taken in their resolution of the 28th ultimo, namely, that "the Board cannot, consistently with their sense of duty to the Bank, and of the obligations of the trust committed to them, consent to give up the custody and possession of th books and papers of the Bank, nor to permit them to be examined but in the presence of the Committee appointed by tho Board. Resolved, That, with every disposition on the part of the Board tocomform to the wishes of the Committee of Investigation so far as it may be dono without a violation of the trust reposed in them, the Board cannot, neverthless, consent to let tho books and papers of the Bank go out of their care and custody, nor out of tho Banking house, which is their proper place of deposite ; and therefore, they cannot comply with that part of the resolu-. tion of the committee of Investigation of the 2d inst., which requires that certain of the books and papers of the Bank bo sent to the N. American Hotel this day at 11 oVIock, believing that this would bo contrary to their duty to the stockholders, and would transcend their lawful power, as well as be liable to be deemed an abandonment of the right to be present by themselves, or their Committee, or agents, at the examination and investiga tion; inferring, m all these respects, o very grave responsibility, which tho Board, in their limited authority, do not think they can be reasonably sequired to assume.
