Tlie bill subjecting real and personal estate to execution, has passed the house of representatives, and the following are its lectures, as it passed the house. Necessary wearing apparel is exempt iron, execution Personal estate must be sold befoi c real estate, and for the best price it will bring. For debt contracted bef re the first day of January, 1824, if real estate is taken on execution, the defendant may require a juy of three disinterested freeholders, to enquire if the rents for seven years will pay the debt, interest and cost ; and also to value the fee simple ; and if it will extend, it is to be first offered for sale in that way ; but if not sold, then the fee simple shall be sold lor i sum not less than half its value ; but this restriction does not extend to any greater quantity of real estate, than half a quarter section of land, or one house & lot in town For debts contracted alter the first day of January, 1824, real and personal estate must sell for what it will bring, unless the rents will pay the debt and costs. If the defendant has a family, he h:is the following personal goods exempt on execution, to wit : one Bible, one Cow and Calf, one Bed and the necessary Bedding therefor, household and kitchen furniture, not exceeding in value ten dollars, one chopping Axe, one weedine; Hoe, one Spinning Wheel, one Reel and the necessary provisions to supply a family two months Defendants may have a stay of execution for ninety days, on all sums, by entering sufficient security except Justices of the Peace, Clerks of the Circuit courts.
