The fact of suit so far from home, will be a stimulus to the collector in distant counties, to make such suit unnecessary An equitable remedy where the bond
should be found insufficient, and where there might be no bond at all, should be created against them To prove that they hid received the duplicates, and that they were sherifTs or collectors in their counties, should be sufficient for the sum stated in the duplicates. The burden of proof, for everything exculpatory, ought to he put upon them. A certain interest too, not to be affected by the contingt ncy of judgments, ought to ensue a failure, (say at the rate of six per centum per annum, from the time payment became due until it should be made) and let this calculation and settlement rest with the auditor This might be in addition to the ten per cent now consequent on judgments, or in lieu thereof With tin so incentives to industry and punctually, there can be no doubt but that collections of the revenue would not only be muc h more prompt and certain, but that in home instances there would be great cr amounts paid. The duplicates might be delivered to the collectors sooner. They should be authorised to collect, and required to pay into the treasuiy at an earlier day, than that prescribed by law. It is confidently believed, that if these changes had taken place in the collecting system last year, and the scminaiy funds In en brought into the treasury, thai we would now have been ahead of oui present condition, eight or ten thotr sand dollars. And it is as confidently believed, that if those measures be adopt ed this year, wc shall be able at our next meeting, to lessen the burden upon agriculture, or dispense with some other object of taxation There is however connected with this opinion, a belief that the obj-cts of appropriation for the present and future years until the state debt be paid, will not be as numerous, as those ot 'lie past year. The penitentary will ivt require so great an appropriation, and the Indianapolis fund will probably meet the demands of the state in that quarter, in the erecting of public buildings On the subject too of taxes on unlisted lands some further accountability of the collectors is necessary. This opinion is
founded on the fact that this provision of
the revenue laws, has heretofore been, almost entirely inoperative. Very few code tors since its enactment, appear to have taken any notice of it. Connected with the state debt, I lay b. tore you voluminous documents, giving a hisiorv of the cancelling on th lotn and 1 7th of September 1822, of g 25,397 of the then existing state debt. Tnose documents have been received vith a request, that they might be submitted to the inspection of the legislatute. O i the subject of electors of president and vice president, no provision authorizing their election hv the people, has as yet been adopted. Some legislative definition seems necessary, to that clause o! the constitution which declares, that ' no act of the general assembly shall be in force, until it shall have been published in print." Legislative construction, seems also necessary on thr.t claUsc of the constitution, which directs the transmission of the returns, and the counting of votes foi g v rnor and lteut. governor. Hoiv when and where the validity of the returns for those officers are to be tested and determined, oug-h to be regulated by law. The resolution introduced by Mr. Law for the repeal of the glOO law (commonly so called) was referred to the committee of revision. Mr. Nelson introduced a bill to amend the act to establish a county treasurer, which was read and passed to a second reading. Friday Dec. 5. On motion of Mr. Stevens: Resolved That the committee of ways and Means be requested to report a bill as early as possible authorising a loan in such way as they may deem expedient, for such a sum as they may deem sufficient, and authorize the treasurer of sate immediately to ascertain if said loan can be procured; and on the failure thereof to authorize the treasury department, to issue the necessary amount of treasury notes,
