The E vansville Gazette, of the 11th inst states, that on Thursday last, came on thi trial of John Harvey for the murderof Thomas Casey, when tne jury after a short absence, returned a verdict ot guilty and he was sentenced to be executed on the 27th inst. " Trials for Murder The trial of Ca-' leb Hiysfor the murder of his wife, came on at the circuit court, of Switzerland county, in (Vevay.) Ind. on the 3d inst. The indictment contained (as we are informed) two counts; one charging liim of giving her wounds of which she died, and the other for poisoning her. The prisoner nlead not erui.tv. After an
examination which occupied nearly the "Whole day, the council submitted the case to the jury under the charge of the court, vithout argument, and the jut y in a short time returned a verdict of not guiily. Also the trial of Sarah Matthews for the murder of her infant child, came on at the same court on the 4.h inst. The indictment contained two counts; one charging her with throwing her child into a privy which instantly produced its death. The other charging her with throwing it into a privy containing ice See and leaving it without assistance or nourishment, by means of which its death was produced. There were but few witnesses, yet the examination occupied the greater part of the day. After lengthy arguments of the counsel on both sides the jury retired under the charge of the court, and next morning returned a verdict of guilty of manslaughter, and sentenced her to one yen's imprisonment at hard labor in the State prison, and to pay a fine of one cent. There lias been an action between the "'rench and Spaniatds at Santos Ladron. The former are said to have taken 70 .irisoners, a part of which had arrived at Toulouse. French loss not stated, nor particulars given. The "royal authorities" had been reinstated at Puyardo to the great pleasure f the ptiests. The severe defeat of the rators, near Valencia, by gen. Abascal, s confirmed. In another affair, the traitor general Morales was taken prisoner The reported capture of the French frigate Guerriere is not true. It is said that St Sebastian' and Pampeluna have been only invested," not attacked yet the papers often speak of the gallantry of the French troops before the former I The duke of Angouleme had passed the Ebro, on his way to Madrid we never expected that he would be seriously attacked or resisted by the Spaniards, until he was in the heart of their country; but they were abandoning their homes and desolating their fields, as we believed that they would and, when the Guerillas are fairly at work,-the French will have to fight, as it were, for every mouthful ofbrcad. A young man, a Spaniard by birth, has been condemned at Toulouse to nine years imprisonment, for exciting the French soldiers to desert. A Spanish vessel, loaded with grain, for St. Sebastian'i, was carried into Port-au-Passage, and an order had been received to take an accurate account of the quantity and pay for it. The insurrection in Portugal, excited by France, was entirely at an end. The following, from the Xational Gazette, piesents a very satisfactory account of the spirit that seems to prevail in Spain of whose success in this contest we have no manner of doubt. We have conversed with a very intelligent gentleman, who recently travelled fmm Madrid to Paris and visited St. Sebastian, on the general condition of affairs in Spain, to which his attention had been directed He mentions that, south of the Ebro, the population appears to be almost universally constitutionalists. The Uw and small bands of insurgents in that quarter, consist chiefly of common marauders, rathei than of political malcontents. North of the Ebro, in the provinces of Biscay, Navarre and Catalonia, the army of the faith has been recruited by means of French gold, which the lower classes of inhabitants were too poor and wi etched to resist. Circumstances had had p rticularly impoverished, and desolated those province; and their proximity to the French territory laid them open to the bribes, and intrigues of the French government, and the Spanish refugees But the influence of the priesthood had not been much exercised upon them, nor was it in any degree as powerful as it had been, in any part of Spain Much less is to be apprehended for the constitutional cause, from this source, than from the want of money, and the material of war. The garrison of St. Sebastian was composed of about 2,100 men, and commanded by O'Donnel, a brother of the able general of the same name The utmost reliance is placed upon his firmness and the bravery of his troop; but St. Sebastian, being a fortress only of the second order, and not in perfect repair, may be taken by the French engineers General Mis a had under him about twenty thousands regular troops, ten or eleven thousands tried militia; all animated bv the best spirit. General Morillo had invested nearly his whole fortune in the funds of the constitutional government, as a pledge of his sincerity; and further to obtain confidence, had chosen as his second in command, Baliasteros,

not sustain him under such circumstances The Portuguese troops within Montevideo, who have occasioned this state of things, will probably fall a saciifice to the jealouiy of the people of the Patria, when they may have succeeded in driving away Le Cor and his army The people and government of Brazil ought to rejoice in the necessity, which will oblige them to abandon an attempt, their good sense ought long since to have determined them to relinquish There cannot be a doubt they wouid have bsen compelled to do so ultimately, and after wasting a vast treasure, w hich they want for more attainable and important objecti, and the sacrifice of a great many brave and valuable troops to say nothing of the indiscreet ambition manifested by their grasping, with one hand, at a neighboring district of country, to

members of the coites, who "'-.louiucd to upwards of one hundred and fifty, and hold the most respectable personal characters, professed the same opinions and fecl'n.gs. ' None of them considered the occupation of Madrid by the French as at all likely to prove decisive of the contest. Thev calculated that the Hritish would not suffer the French to carry on any extensive maritime operations against them These they particularly dreaded, as affecting the security of the south of Spain, They did not expect to be obliged to leave Seville; but if so, the retreat to Cadiz would be easy, and the asvlum impregnable. Our informant inferred, from what he saw in the French provinces, and in Paris, that the war and the Bourbons were unpopular, to use the softest term.
