American Eiom the National Intelligencer. July 30 We vestctday received the firM nn bvr of a paper c;dl d Th Florida Ga-r-fr, primed at St Augustine, Eea-t Florida on the I4!h ins ui, by Richard AV E des and Co. It contains an account of the surrender ol the teiritory An apology is made for the deku in commencing the pubiicaii m, which was caused by the rtfusd of the Spmish authorities to permit i's publication as lonu 'he territory remained in their possessi' ! No civil ohVcr had yet reached the tcrritOM, except Mr. Forbes the Marshal Go ge Gi!)bs wa app intc Colonei linger, to be v ollcctor of the j erf firo t wfnrr. A comniunication appears in the paper, ca'ling a meeting of tin- citiz- ns, with a view of lo warding to G.ne;il lackson a remonstrance against that part of his proclamation which continues th, laws and municipal regulations of the Province, and entrusts their execution to the Spanish officers. The ground taken bv the writer of this communication is, that kin anv portion of territory over which the Hag of the United States waves, the government can on'v b administered according to the prineiples of the Vmeri can constitution, or by martial law." The whole of this difhVu ty is solved by a reference to the constitution and the law s of the Uniu d States. The constitution says : u The Congress shall have power to
dispose of. and make ail tu edful rules and regulations respecting, the territory or other property belonging to the United Statik; at d nothing in t.is tonsntution slull he so construed as to prejudice any claims of the Unit:d States, or of anv paiticCiUr state." The law of the last session passed undci this clause of the constitution, enacts "That, until the end of t .r fu st sessiot of the next Congress, uiks provision for tt mporat y government of said tertitoties be sooner made by Congress, all tie unitary civil and judicial powets cx rcised b the officers o the existing government of the sunc territories, sh.dl be ested in such person and person, and shad be exercised in such manner, as t'u Presi lent or the United Mates shall direct, for the maintaining the inhabitants of snid territories in the free enjoyment of their liberty, prosperity, and religion." The President, in the execution of this authority, ha, it appears, directed that, until otherwise ordered, the municipal sh dl remain as th v are. and the same of
ficers a- under the Spanish government shad continue to execute them. Whether th's be right or wong, it is certainly conformable both to the law and constitution. If those late Spaniards are found incompetent to the discharge of the duties confided to them, they will doubtless be immediately displaced. Since the above was in tyne, we have ad the pleasure of seeing Major Cro, of the quarter master's department who left Saint Augustine on the '7th inst On the previous dav, the 1 6th. the fleet railed for Havana. The aiticle of fuel is inexhaustible on land that must for at ieast a century to come remain free, immediately south east of the common ; and on a hill comnaonljr called u Bunker's Hill," there is every indication of stone coal ; this hill is part Common's property. But although all these facts alone arc in regard to this particular, stifFicicnt, it may be proper to add, that wood is brought down the river, and now delivered at the dwellings ol our citizens, for one dollar per cord; coal for five cents per bushel; and at no time could the Commissioners or Superinttndant of the Poor houst, fail, on advertising for a public contract, to supply fuel for the season, to render the expense as little as it might become in any part of the county, where but a few could supply the at tide. In regard to water, there are excellent springs in various parts of the Common, ami in no part can a well fail to produce the most excellent. In regard to a market, which must in time become a very important point, the establishment should unquestionably be contiguous to a good one.
