A convention between his Catholick Majesty and the United States of America, for the indemnification of those who have sustained losses damages, or injuries, in consequence of the excesses of individuals of either nation, during the late war, contrary to the existing treaty, or the laws of nations His Catholick Majesty, and the government of the UnitcdStates of Ameiica, wishing amicably to adjust the claims which have arisen from the excesses committed during the late war by individuals of either nation, contrary to the laws of nations or the treaty existing between the two countries : his Catholick V ajesty has iiven. for this purpose, full pou crs to his Kxceilency Don Pedro Cevailos, Counsellor of State, Gcnticman of the Bed 'hamber in employment, first Secretary of State and universal despach, and Superintcndant Genera! of the Posts and Post Olnces in Spain and the Indies; and the government of the United States of America to Charles Pinckney, a citizen of tiic said States, and their Minister Plenipotentiary near His Cathoiick Majest vwho have agreed as follows : 1. AA Hoard of Commissioners shall be fotVil composed of five Commissionersjttp of whom shall be appointed by His catholick Majesty two Others by the government of the United States, and the fiftl by common consent; and in case they should not be able to agree on a person for the fifth Commissioner, each party shall name one. and leave the decision to lot: and hereafter, in case of the d ath, sickness, or necessary absence of any of those already appointed, they shall proceed, in the same manner, to the appointment of persons in replace them 2. The Commissioners shall meet 8c bold their sessions in Madrid, where, within the term of eighteen months (to be reckoned fiomlhc day on Which they may assemble) they shall receive nil claims, which in consequence of this Convention may be made, as well by the subjects of His Catholick Majestv, as bv citizens of the United States of America, who may have a lie.ht to demand compensation for the lossea, damages or injuries sustained by them, in consequence of the excesses committed by Spanish subjects or American cit:z he. 4. The Commissioners are authorised by the said contracting parties, to hear and examine 6n oath every question relative to the said demands, and rcceive, as worthy of credit, all testirnony, the authenticity of which cannot rkWiably be doubtc d. 5. Now, therefore, be it known, that I, JAMES MONROE, President of the United States, have caused the said Convention to be made public to the end that the same, and evcrv clause and article thereof, may be observed, and fulfilled, with good faith, hy the United Statrs, and the citizens thereof in testimony whereof. 1 have hereunto set my hand, and caused the seal of the United Slates to be affixed. Be it enacted t-y the SenMte tknd Houkt of lit fin sentatives of the United States (J America in Congress aase?nhlecL That the register and receiver of the land office at Vincennes, be, and they are hereby authorised to permit William Barton to withdraw his entry of the north-east quarter of section three, in township six south, of range twelve west, in said district, and to place the moneys by him paid on the said entry, to his credit, on any purchase of publick lands he may have made or shall make in the said district ; provided it shall appear to the satisfaction ol the said recrister and receivcr, that the numbers on the corner designating the north-east quarter of thirty-one, in township six south, of range twelve west, in said district, were so defaced or imperfectly made, as to have caused a mistake in his aforesaid entry.
