If any person who shall and may be appointed as such Judge or clerk of elections, shad neglect or refuse, upon being notified thereof by the Clerk of the oard of Trustees, whobe duty it is hereby made so to do, to discharge the several duties enjoined upon hi n or them by this ordinance lie or they shall be severally fined in the sum of Sixty Dollars each, to be recovered by indictment in the Circuit Court ; the one ha'f when of shall go to tue informer and the other half he paid to the Borough Treasurer for the use of tne Borough, provided such person or persons has not a reasonable excuse to exempt him or them, in the opinion of the board, from prosecution.
