During the cession of the court of Common Pleas for tnis county last week a cause was tried which excited no small interest in the public mind. An action was brought by James Smith, President of the Owl Cieek of Mount Vernon, against Leonard Jarvis, to recover the sum of one thousand dollars, w ich had be(n borrowed of the Ow, Creek ank, with interest. The suit was brougflt upon a note executed in favor of James Smith, and made pavable at the house of L. S Siiliman The cause was abi argued by Messrs Siiliman, Harper and Stockton, for the plaintiff, and Mess's. Culbertson and Granger for the defendant. The council for defendant pleaded the law of the state against the claims of unauthorised banks, and maintained that no debt could be recovered by them. The plaintiff contended that this hank came not w'f.in t e statute on the subject, and that the law- prohibiting the circulation qf unauthorised bank paper were unconntutional. 1 Judge Wilson President of thcoArt, charged the jury in an able manner, on the several points connected with the case. The jury returned with a verdict in favor of the Plaintiff, f r the full amount of the demand tuiti interest.
