The commanding oflicers of regiments, battalions and companies in each county, ih-11, on the full day of May next, meet at their rrf'-tfive court houfts, there to divide the counties into diltricts, for the ptupofc cf forming the regiments, battalions and companies, bv thii ad ciU'olilhcd, whith ditltid io laid off, lhall be de(ignttd by certain lines and bound, to be by thrni ettablifiied, and which hall be recorded by the judge advocate, as clerk of each regiment : Provided eiwJVSi That if emigration into any of the company dittri&s, lhall render it nrcelTry to form new dillricls,fo as to affix to each dill lift its proper number of effective militia, it (lull be the duty of the cap tain of each company, which Hull ha?e incrcafed above the proper number, to notify the commandant of the battalion, to which fuch company belongs thereof ; who fhall give the like'information to the commandant t his regiment, whole duty it (hall be to caufe a meeting of the commanding etneers of the compmies of fuch battalion, or regiment as the cafe may be) from w hich futh new company is to be taken, at the molt convenient place in the battalion, or regiment, as f oii as may be; ajid the officers fo met, (hall proceed to divide fuch dittrict, in cafe it contains a fufluient number of effective men, fo a& to form two companies, or othervvife to take from the feveral adjoining .din is, fuch parts as thry can fpare, without reducing the original company or companies, below their proper quota, and thereof form one new company. Sec. 8. No perfon (lull be eligible to a command in the militia, who is not a citizen of the United States, and has not redded twelve , months in this territory. Sec. . Every officer commiflioned by virtue of this aft, fhall, previous to his entering on the duties of his relpective office, take the oath of allegiance to the United States, and the following oath or affirmation, to wit : 44 1 do folemnly fwear(or affirm as the cafe may be) thu I will faithfully and juflly execute the duties of a in the militia of the territory, according to the belt of my abilities. So help me God." Which oath or affirmation, fhall be endorfed on the back of the commiflion by the perfon adminifiering the fame. Sec. 10. All commiffioned officers Anil take rank according to the date cf their cemmiffiens, and v. hen two or more of the fme grade be of equal date, then their rank to be determined by lot to be drawn by them before the commanding officer of the brigade) regiment, battalion, company or detachment. Each battalion and regiment, fhall be provided with regimental ftandards, with the number of the regiment inferibed on the Tame, by the field officers; and each company with the regimental colours, with the number of the company in fuch regiment inferibed thereon ; a drum and fifr, by the commiffioned officers 61 the compa rv, in fucb manner as fhall hereinafter be directed. ' Sec. 12. There fhall be an adjutant general appointed in the territory, whofe duty it flnll he to dittribute all orders from the commander in chief of the territory, to the feveral corps ; to attend all public reviews, when the commander in thief fliall review the militia, or any part thereof ; to obey ail orders from him, relative to carrying into execution, and perfecting the fyttem of military difcipline, ettablifhed by this act ; to fumifh blank forms of the different returns 'thai ony be required, and to explain the principles on which they (hould be made ; to receive from trn-officers of the different corps throughout the territory, returns of the militia under their commands, reporting the actual fituation of the arm?, accoutrements and ammunition, their delinquencies, and every other thing which relates to the general advancement of good order and difcipline ; all which the feveral officers of the diviuons, brigades, regiments and battalions, are hereby required to mke in the ufual manner, fo that the faid adjutant general m .y be duly fumifhrd therewith; from all which returns he fliall make proper abttracts, and lay the fame immediately before the commander in c hi-F of the territory : Provided always That the adjut ;nt general of the militia of this territory, fliall be, ex officio, infpettor general of the fame. Sec. 12. It fhall be the duty of the commanding officers of each and every company fo enrolled, forthwith to dividr his company into divifions by ballot, from one to eight, for the pnrpofe of a regular rotine of duty, when called into actual fcrvice, and fliall return a matter of fuch divifion, with the rotative number attached to each clafs within fifteen days, to the commanding officer of his battalion, who fliall, forthwith tranfmit the fame to the commandant of the regiment, who fliall order the fame to be recorded by the judge advocate, as clerk thereof. Sec. I T. Every militia man removing out of the bounds of one company to another, fhall apply to the commanding officer of the company he is removing from, who fliall give him a difchargr, certifying the clafs to which he belongs, Which certificate the faid militiaman ftull produce to the captain or commanding officer of the company in the riiltricYin which he fliall next fettle, within ten days after his fettlement ; and the faid captain or commanding officer is hrrely required to enrol him in the clafs fpecified in faid certificate ; and on failure of any militia man, obtaining a certificate in manner aforefaid, and pre fenting the fame as before directed, the captain or commanding oflifer of the company to which he fliall remove, is hereby required to enrol fuch delinquent the foreniott in the firtt clafs for duty, notifying him thereof, and that he mutt hold hiaifelf in readinefs to perform any duty by this ad required. Sec. 18. There Ih til be private mutters of each company of cavalry, artilery, grenadiers, light infantry and rifle-men, oiue in every two
months, at fuch time and place as the commandant thereof fliall ap point, except in the months of December, January, February and March, in every year ; and every other company formed by virtue cf this act, once in every two months, except as before excepted, to be appointed by the commanding officer theieof, at, or as near as may be the centre of the company dittricl ; there fliall be a mutter of each battalion in the month of April, in every year, which fliall be appointed by the commanding officers of the refpecYive regiments, who fhall Sx on the moft fuitable place, as near as may be to the centre of the battalion dittrift, and fhall fuperintend the cxercife, and direct theevo lutions that fhall be performed ; and there fliall be a mutter of each regiment in the month of October, in every year, which fliall be appointed by the brigadier general or commanding officer of the hrigade to which fuch regiment belongs, at, or as near as may be to the cehtre of the regimental dittrid, and flull be made under the fuprrintendance and direction of the brigadier general or commander of the rrgiment ; which company, battalion and regimental mutter, fliall continue one day each, and no longer. Sec. 19. The brigadier general, or commanding officers of brigades fliall caufe notice in writing of the times and places of the faid mufters, to be given to the commanding officers of regiments at leaft twen ty five days ; the commanding officers of regiments fhall give notice

the battalions at leaft twenty days ; the commanding officers of battalions fliall give notice of the rigimental and battalion mutters to the commanding officer of companies at leaft fifteen days ; and the captains or commanding officers of companies flialf give notice of the regimental, battalion and private mufters to the individuals of their refpecYive companies, by themfelves or fergeants, at leaft five days before fuch regimental, battalion or company muttei, (as the cafe' may be) fhall be nolden ; the notices to be given by the commanding 'officers of the brigades, regiments and battalions, fh dl be in writing, and del.vered to the perfon or perfons, or left at the ufual place of hia or their abode, by fuch commanding officers themfelves, or fucli other officer
or officers as they may think fit to order ; ana the commanding ottoCcrsof companies fhall have power to affign to each fergeant of their refpeftive companies, his due proportion thereof, whofe duty it fliall be to give the notice before directed to that portion of the company to him affigned, which may be done by perfonal fummons or by leav ing notices in writing at the ufual place of abode of the perfon to be notified. Sec. 20. The militia of the territory fhall be divided into diviflons and brigades, at the difcretion of the commander in chief ot the miiittd. Sec. 21. Every officer and foldier flrail appear, at his uipechvc muf ter field on the day appointed by eleven o'clock ; and at every mutter, each captain, cr commanding officer of a company, fhall onect the firtt frrgcantof his company, in his prefence to call the roll at halt pall eleven o'clock precifcly, examine every perfon belonging thereto, and note down the delinquencies occurring therein, and make return thereof, as well as of the flrength of the company, number ot uficst mufkets, bayonets, fufees Sec on parade, to the commanding officer ot his battalion, within ten days after any fuch regimental, battalion or company mutter; and every commanding officer of a battalion, fliall, at his regimental or battalion mutter, (as the cafe may be) at the hour on which the battalion is to be formed, in like manner proceed to call the names of the commiffioned officers of his battalion, examine and note down all delinquencies, and make return thereof, together with thofe reported from commanding officei s of companies, to the commanding officers of the regiment to whith he belongs, within. Glteen days next fucceeding fuch battalion or regimenul mutter, (as the cafe may be) who fliall lay the whole before the court hereafter appointed to take cognizance, and determine on them, and to each of the faid returns flill be annexed the following certificate, to wit: k I do certify, tint the returns hereunto annexed, contain' all the delinquencies which have occurred in my company, (or batuhwii as the cafe may be) fince my latt return."
