.Almost Piracy —i'ne Sciir. L^kr Serpent," Cap». James Foster, lef 'hi- port about six weeks since, with a cargo of provisions, lor Red Ilivei in Canada. It seem thaf a man living at Maldftn, having learnt her destination, went to the collector at Maiden, Mr. Hand, and entered complaint against his vessel
MR
Hand deputised the hero who provided himself with arms sufficient for seven men, and arrived at the settlement on Red River, i"
It seems that this was done while the Schr was yet laying at the dock in the city of Detroit. However the vessel left Detroit to her place of destination, & while crossing the lake, the Capt took a canoe in tow, in which were two men and a couple ot trunks. Alter running some time, it began to blow fresh, and the trunks were taken on board they entered the river—the trunks were put into the canoe —the men got in and shoved off, after au otl'er ol recompence to the Captain, which he refused, saying
,4if

one who wants as much assistance, give it to him,''—thus they separated The vessel wa» moored aloo^ side the dock,—the Captain went to transact some business, and on his return, in the course of half an hour, his vessel was seized &Ld every hand ordered ashore..,-. The deputy now demanded his papers, but was told he 9hould have made the demand before ne seized th vessel, and refused. A general tau*ack of the vessel now took place.
The Captain informs us that nothing which the desire of any of the mob hit upon was sparid. A but 15cwt of cheese was destroy•ed, and other things in proportion in the following manner.—they would take up a hnndsomc*'cheee and cut it iu two, if it did not exacly suit the ta*t^ of the cutter, it was thrown down upon the deck, fit so on till his 15 cwt. of cheese was cut to peices and trod upon the deck. .Whiskey was used freelv articles of furniture were taken a way, and provision carried off b\ the mob that had assembled to assist in taking this smuggler, who had not been in port two hours, and the law allows a vessel to lay in port without breaking bulk, 24 hours before she is compelled to report
The next day the deputy put his horses on board and sailed to MaU den, when another distribution li the ttr*o took place, without anykind of account being kept, as to what it was, or how much
After the seizure of the vessel, and destruction of the property, the Capt. took the necessary aflidav t- of men unconcerned, procured a guide, and striking throu^ti the wood«, ar rived at York, rhe seat ot Government for the Upper Province, in seven days. He laid his case before Governor Colburn who, after deliberating with his council five daysppon the subject, nave an im perative order for the immediate
The Capt. received the vessel in a destitute condition the furniture having been principally pilfered. We understand the Capt and own ers will proceed forthwith to York,
for
the purpose of obtaining remuneration through the Government authority.
It appears that the reason given by the deputy for the seizure of the vessel, was, that the trunks of the two men in the canoe, whom Capt Foster had taken up in distress, proved to
