Jie it enacted by the Senate 6f House of Representatives of the United States of America in Congress assembled, That the Secretary of War be, anu he is hereby, authorized and requi red to procure, as soon as it caf be effected, on reasonable terius, a site for an Arsenal on the waters of Mo bile or Pcnsacola Bays, and to cau ^e to be erected thereon such an arsenal as may be deenjed proper, for the safe keeping* of arms and munitions of war of the United State*, for the Mexican Gulf frontier: and that for these purposes the sum\of fifty thousand dollars be, and the same is hereby appropriated

hereby granted to the slate of Onto, to be subject to the disposal of the Legislature of said State, for the urpose aforesaid, and no other: Provided, That said Canal, when completed, shall be, and forever remain, public highway, for the use of the Government of the United States, free from any toll or other charge whatever, for any property of the United States, or persons in theii service, passing through the sameAnd Provided, also, that the exten sion of the said Miami canal shall be commenced witinn five years, anc. completed within twenty ^rears, or the state shall be bound to pay to the United States the amount of anv lands previously sold and that the title to purchasers, under the State, shall be valid.

Sec. And be it further enacted, That so «oon as the route of said canal shall be located, and agreed on by said state it shall be the duty oi the Governor thereof, or such other person or persona as may have been, or shall hereafter be, authorized to superintend the construction of said canal, to examine and ascertain the particular lands to which the said state will be entitled under the pro visions of this act, and report th»same to the Secretary of the Treasury of the United States.

Sec 8. And be it further enacted, That the State ol O no, under the au thority of the Legislature thereof,after the selection shall have been 9" made, as aforesaid, shall have power to sell arid convey the whole, or anv part of said land, and give a title, in fee simple, therefor to the purchaser thereof

Sec 4 And be it further enacted, That the S(a-.e ol Indiana be, and hereby is, authorized to convey and relinquish to the state of Ohio, up such terms as may be agreed upon by said states, all the right and interest granted to the said state of Indian*, to aov lands within the limits of the State of Ohio, by an act, tititled

Sec. 8. And be it further enacted, That each head of a family, widow or single man, over the age of twen ty-one years,actually settled on that part of the Territory of Arkansas, which, by the fiist article of the treaty between the United States and the Cherokee Indians, West of the Mississippi, ratified the twenty third day of May, one thousand eight hundred and twenty-eight, has ceased to be a part of said Jterritory, who shal remove from such settlement accor ding to the provisions of that treaty -hall be authorize to enter with the proper Register of the Land Office in Arkansas, a quantity not exceeding two quarter sections of land, any of the public lands in that Territory, the sale of whicu is authorized by law, and in conformity with the lines of the public surveys, at any time within two years from the passage of this act and upon presenting •he certificate of «uch entry to the Secretary of the Treasury, a patent shall be issued to such settler, or to his, her or their heirs, tor the landMO entered, as a donation from the United States, as an indemnity for the improvements and Losses of such settler under the aforesaid treaty,
