AN ORDINANCE

Regulating the Public Burying Ground. Srrriox 1ST. Be it ordained by (be Common Council of the city of Ten* Haul*, Tbat L/ta No. 37, 38. 47 and 48 in the subdivision of socs ion sixteen, Harrison Township, Vi«o county, are appropriated to and constitute a Public Burying Ground for the use of the citv and that the map or platt of the tubdiviciona of said LJta asreeorded in the ordinance book of the town of Terre Haute be confirmed, and that all the avenue* and alleys therein delineated be reaenred aa common

^^ectiok 2D. Be it further ordaloe& That all lota situated in the subdivision of Urt38, bediftded into four claasea aato priee. The out metier of Iota on each aide of Let 38, firoatuiff"on main streets, at |K each. The in lots, or those fronting on natrow streets, ot §10 each. Quarter lota fronting the streets, and corner lota on the main atreefs at $3,00. The quarter 'ota fainting on alley a at $2^0. Any person or persons waning to purchase any ot aaid lots shall, upon producing the Treasurer'a receipt, for the price of such lot. be entitled to a conveyance—executed by the Clerk, end attested by the City Seal, conveying to each person or persons the excluwve use of such lot or lots for the purposes specified in section first, and sutject to the control of the Council, of which conveyance the Clerk shall krp a record.

That the certificates ofconveyance for aaid lots are assignable,and that such assignments shall be evidenced by a "transfer** executed by the City Clerk upon the back of aaid certificates, attested by the City Seal and that no such aasignment of said certificates shall b« recognized by the sexton save such as are thus authenticated. Provided further, that the Clerk shall enter each transfer upon his Rccord of Convsyanoes at the time of attesting the aame. for which entry and attestation be shall be entitled to the sum of twenty-five cents, to be paid him by such assignor. 8ecrioi« 4TH. Be it further ordsined, That Blocks Numbering from 7 to 18 inclusive in the survey of Lot No 37, be sold lor the sum of one dollar each, and in the manner heretofore provided in scction second of this ordinance. And that blocks No.7,8,9,&, 10 in Division of the survey of said section, be reserved for the burial ol transient i*rtons and paupers and that Blocks No. 15, 16, 17 and 18 in the aame division of said survey and section, be alone appropriated to the burial of negroea and mulattoes, and be sold in the manner and at the rates heretofore designated in the first part of the section, (excepting block No. 18, it being leserved for the burial ol pauper negroes and mulattoes.) Provided further, that any person or persons who shall purchase, burv, or attempt to purchase ar bury any negro or mulatto upon any lot or block except blocks No. 15,16,17 «ud 18, in Division C, as above designated, shall forfeit and pay to the City of Terre Haute a sum not exceeding dollars and costsof suit.

Council may elect a Sexton, who shall hold his office during the pleasure of the Council. whose duty it shall be to take charge of. superintend, and preserve fiom injury said Grave Yord, attend funerals, dig and fill graves, and give directions as to where transient persons and poupers shall be buried, fie shall keep a Register of the dale of Interment, name and age of all persons buried, designating the No. of the lot or place of interinent.and roport the same to the Common Council monthly. Provided further, thai said Sexton, as a compensation for his services, be allowed for digging and filling all graves for persons under ton years old, 0110 lollai otid a half each for digKing end filling all graves for persons over ten years of age. two dollars, to be paid in advance by ih© person or pcraona employing him, and on allowance at the rate of ten dollars a year for making the monthly reports heretofore mention ed. He shall also bring, or caused to be brought to the grave, free of charge, the coffin-box, if one in to be used and dig all graves for persons under ten years of ago, four feet deep, and all graves for persons over ton years of age, he shall dig live leet deep.

Be it ordained, That any person

or persons who shall, contrary to tlio nroviBions of this ordinance, inter, or cause to be intered, the body of any deceased person upon any lot or niece of ground within said burying grounds, (or upon out of No. 3. commonly known as the old grave yard,) for which lot said person or persons shall not have a regularly authenticated certiorate front the Clerk, shall forfeit and pny to the city a sum not to exceed fifty dollara and costs of *Upi-.CTION 7TH. Be it ordained, That no owner of any lot in said burying grounds, shall erect around said lot any pailing or frame worfc ol wovd, but may plant at the corner, and in tl\e centre of each side of said lot, an iron fence, not to exceed three feet in height, and may conncet the same each to the other by a chum, or may place around said lot an iron fcnce not exceeding three and a hall feet high. Any person or neraons violating this section, and refusing, when requested by the Sexton to remove the same, •hall forfeit and pay to the town ol 1 erre Houie ilia sum of iweuiy-five dollars ami costs ol suit.
