The preamble states that OM Joseph Rootfen* tend into a contract on tho Tth of June, 1889, with the board of Internal Improvement, for tha ron*ruMkn of section five of the Wabash and Erio v*aal—thai Reoer, with the assent of the acting commissioner or the canal, transferred die contract to the Messrs. Beards—that by tbecontract, theState was bound to pay for the work in par funds, and that the Beard* took it under that expectation—that under the general suspension, their work was stopped—that on the resumption of the work, they by the advice of William J. Ball, engineer of the canal, prosecuted it under the expectation that the State would comply with the contract —and that the State having no par funds, the Beards received their pay In canal scrip, which had become depreciated.
The bill then requires that the government shall appc*& a commissioner to try the claim, who shall appoint a day for the commencement of the trial in Lafayette—that he shall swear witnesses, and examine them touching the matter* to be investigated—that the Governor shall appoint a person to act as counsel for the State on the investigation, the amount of whose fee shall be fixed by the decision of the commissioner—that upon the commissioner awarding a sum against the State and in favor of the claimants, he shall certify to the auditor of the State, and the treasurer shall pay it. An appeal is allowed to the circuit court, or to the newly organized court of common pleas of Tippecanoe county.
Stripped of all irrelevant matter, the complaint in brief is, that contractors found the state unable, in consequence of her credit, to pay them for their work in pur funds, as required by their contract—that instead of abaiykming it, and giving the state an opportunity of employing others, as they might have done, they went on and finished it, received the state's promissory notes for the amount (on the principle of an accord and satisfaction,) and passed them away, while ths state has since either taken them up at par, or has made ample provision for doing so.
And now the question is shall the state, besides redeeming her paper at its face, and according to its terms, oe required to pay the contractors the loss they have sustained by bargaining it away at less than par?
Is an individual debtor required by law to do so? And if not, ought the state, struggling as she now is to pay her debts, to be held to a stricter rule?
Surely not for the receiving the scrip under protest even if made—a protest made to a state officer, who could not change his course consequence, but was compelled by law la pay it over, protestor no protest, cannot alter the case. Nor can the advice of Mr. Ball to the contractors, to proeced with their work—nor can his opinion given to them, that the state would pay them in par funds, (if such opinion was ever given,) make the state liable.
Such an opinion at that dark period of the state misfortunes, could not have been believed and rven if it were believed, Mr. Ball had no authority thus to bind the state.
Silt decisive as I regard the above objection to he, the precedent to be established by the passage of this bill makes a far greater one. The same reason would require the state to make up the difference to every other contractor and state officer who have received scrip for their claims, or service*.
Effort* have been made to convince me that thcro is a distinction between the present claim, and others where a depreciated scrip has been received, but without effect. I can see no difference in principle and the alight difference in form would be overcome with afar less stride hereafter, than that taken to pass the present bill. But if the amount of this depreciation is made up in the case of all other contractors, what will be the result I To answer this question, it is necessary to soe the amount of scrip issued.
The amount of and $50 scrip paid to contractore on our public works, when the system was broken down and the credit of the state gone, was

1,500,000. The scrip issued on the canal east of amounts to $121,761 28, and that issued on it westof that place, to $189,980—making in all $2,741,741 28. I am informed from a reliable source, that the first description of scrip was depredated soon after its Issue, to from 53 to 65 cents on the dollar, and the second and third description, to about 10 cents on the dollar. This makes a total depreciation, of about thirteen hundred thousand dollars, which the state, (besides meeting the scrip at par,) would, by carrying out the principle of the present bill.be obliged hereafter to pay out of her exhausted treasury.
Rut this is not all. By tho same principle, or an easy consequence from it, a heavy and still increasing amount of interest, would also have to bepaid on that depreciation.
The principle of the bill does not relievo the laborers on the public works, the farmers, and others who received this scrip from the contractors it only relieves those who received it from the state —-tno contractors themselves.
The only way in which the laborer and community will be affected by it (after having suffered their own share of the depreciation,) will be to lie taxed to make up the lu -t sustained by the wealthier contractors—and that, too, when it is believed that in nearly all cases, the contractors paid off this very scrip to the real sufferers AT PAR, and consequently suffered no loss whatever. Thoee who really suffered, (or at least suffered tho most,) will be imured, not benefited, by the principles sanctioned by this bill, while the others who paid off their debts with the scrip, and at par, will reap all the advantages. Is this justice?
Again. Why is an investigation necessary Not to settle the facta. The nature of the contract, the amount of scrip paid to those claimants, the extent of its depreciation, Sc.c., are well known.— The importnnt facts, whatever they are, are susceptible of office or record proof. Nothing remains to be decided, but the principle referred to, shall any allowance be made by the contrac-
my judgment, that they calculate the difference, tnd to make allowance at once from tho Treasury, than to incur tho heavy expenses of a protracted investigation, the costs of a long trial, for the pur* pose of ascertaining facts already well known.
Another objection to this bill, I have already remarked upon in another communication. So many bills have already pa^ed, or are vet before Uw Legislature, contemplating a heavy disbursement from the treasury tor individual claimants, that there is great danger of hs disabling the authorities of the state, from meeting other indispensable engagements, aixl especially from paying the inforest "n the state debt. Before these bills should suffered to pass, or before an expense of any kmd of the same amonnt should be authorized, the taaes should be correspondingly increased. Thev must be increased hereafter, if these expenses are incurred, ana better now if ever. This policy would answer tha double purpose of preventing prodigality, and of preserving our public faith inviolate.
But I am not advised that any such increase is, contemplated, nor, indeed that the state officers 1 are to be authorised to borrow any to supply such' probable deficiency.
In conclusion, I am clearly of the opinion, independently of all that has been said, that (at least

Great Flood of 1847 will be long remembered in many parts of the West. The swollen Btreams seemed to know no bounds, but rising higher and higher, carried dismay to tho inhabitants. Merchants were obliged to remove their wares from the rivers' sides to remoter places families were compelled to desert their dwellings the poor suffered more severely than language can describe. The public authorities were called on to administer aid and counsel. In shorts great public calamity had occurred.

Answer: "The cause of bilious derangemeut has its principal source in half-dned margins of rivers All history and experience prove this theory. When the British army encamped on the plain of Estramadura, at a time when the river Guadiana had become dry after a flood, remittent and intermittent fevers raged among the troops with such malignity, that they came nigh being extirpated.
THE GRABFENBERG COMPANY therefore earnestly call the attention of the entire West to their most extraordinary and celebrated scries of Anti-Bilious medicines. In any locality where there is the slightest tendniqr to any form of Fever, Fever and Ague. Dumb Ague and the like, tbe inhabitants should at once send to the (teneral Agent of the district, and have a Graefenberg depot established near ihwn. THE
undersigned, thankful for the very liberal patronage ne has received from the public and anxious to merit and receive further favors in his line of business, would say that he is still manufacturing Wagons, Carts, Drays and all kinds of heavy vehicles at short notice, and of the very best materials the country can furnish—both Timber and Iron—and his workmanship where known will speak for itself, and as it is the way he makes his living he cannot afford to do bad work and use bad materials. If he Were a merchant, and could get work made up for Calicoes and Ribbons, without any hard knocks of bis own. and could use puddle iron, such work could be sold cheap, and if such work be wanted (these hard times,) he can eiake and sell wagons at sixty dollars. His painting is not done in a gaudy style, (to draw the aUsntion from a close inspection of parts more vital to good article,) but plain and of the best red lead or any other plain color that may be wanted. He uses none but Shoenberger's best Juniata iron, and if his or some other good maker's name is not found stamped on the tire and other parts, beware of it. He warrants his wagons, materials, and workmanship, for two years, but not being a merchant wagon-maker, he not prepared to barter off his work, but will give every facility he can to his friends, at bis old stand, (a little east of the two spinning wheels.)
