LEGALS BOARD OF COMMISSIONERS OF KOSCIUSKO COUNTY, OH DECEMBER 8, 1987 ADOPTED THE FOLLOWING: ORDINANCE 87-7 AN ORDINANCE REGULATING DRAINAGE FROM PRIVATE DRAINS AND OTHER SOURCES ON TO COUNTY ROADS OR COUNTY ROAD RIGHT-OF-WAYS AND FIXING PENALTIES FOR VIOLATION THEREOF WHEREAS, THE BOARD OF COMMISSION RS of the County of Kosciusko has the power to regulate the use of public ways and rights-of-ways; and WHEREAS, the Board of Commissioners has determined that the unregulated drainage from private drains and other sources on to county roads and county road right-of-ways may create a hazard to the health and safety of the users of the county highway system. NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the County of Kosciusko as follows SECTION 1. That no person, firm or cor cause any roof drain, basement drain, septic field drain or similar private drain to drain directly on to any county road without having first secured the written consent and approval of the Kosciusko County Highway Engineer. SECTION 2. That no person, firm or cor poration shall cause any roof drain, base ment drain, septic field drain or similar private drain to drain on to any county road right-of-way without first securing the written consent and approval of the Kosciusko County Highway Engineer. Highway Engineer is hereby authorized to grant approval to persons, firms and cor poratlons to cause drains to dram upon county roads and county road rlght-of-ways provided, however, such persons, firms and cor poratlons shall meet all requirements of the said County Highway Engineer prior to the installation of said drains. SECTION 4. The Kosciusko County Highway Engineer shall, in instances where persons, firms or corporations are currently draining on to the county road or county road right of-ways, advise such persons in writing that their continued drainage on to the county road or county road right-of-way is subject to obtaining written approval by the County Highway Engineer Written Notice shall provide a time limit, not to exceed 30 days, for obtaining said written approval or otherwise obtaining conditional approval pending construction of satisfactory facilities to meet the requirements of the County Highway Engineer. SECTION 5. Any person, firm or corporation who violates any provision of this Or di nance shall be deemed to have committed an Ordinance violation and, upon conviction, shall be fined not more than $300.00 for the first violation and $300.00 for the second and each subsequent violation. Each day a violation continues after the expiration of the time set forth in any written notice given by the Kosciusko County Highway Engineer hereunder shall be deemed a separate viola tion. SECTION A. Any person, firm or corpora tion violating any provision of this Ordinance shall, in addition to any fine, be required to pay unto Kosciusko County any costs, ex pense, loss or damage suffered by the County due to the violation, including its reasonable attorney fees in the enforcement of this Ordinance.
SECTION 7. This Ordinance shall be in full force and effect after its adoption and publication as required by law. Dated this Bth day of December, IW7.
