Kleinrichert trial underway
By CARLA GAFF Staff Writer After a lengthy quizzing of potential jurors, a seven-woman five-man jury was selected to serve on the three-day Charles Kleinrichert trial. $ Kleinrichert, 24, is a former Wawasee High School student and a r 2 Syracuse resident. He was charged with one count of dealing cocaine and one count of possession on Aug. 28,1986 He is pleading not guilty to both charges in Kosciusko County Circuit Court. County prosecutor Michael Miner stated in his opening statement, that essentially the evidence is very simple and will show Kleinrichert had $2,000 in marked bills in his possession after selling a controlled substance to undercover police. However, defense attorney Allen Stout contends, "Fortunately we believe the case is not cut and dry." He further stated Kleinrichert was set up and didn’t mess with the stuff (cocaine), as he was actually in the process of selling television equipment when he received the money. Continuing, Stout explained, Kleinrichert was set up by an informant, Paul Collier, who actually had possession of the drug Snd passed it off to the officer, by way of Kleinrichert. He said his client did not have possession of the substance until Collier asked him to give it to the undercover officer for him. Stout remarked, ‘‘We believe that Charlie Kleinrichert did riot knowingly sell cocaine.” The arrest was made near the informant's house (where the sale was made) on Blueberry Island at Dewart Lake. Four officers were involved in the apprehension. Kleinrichert’s girlfriend, Anita Cramer, was in the car with him. She is anticipated to testify for the defense of Kleinrichert during the trial proceedings. Stout questioned county procedures regarding the state’s involvement if the case was so simple and said, “Kleinrichert’s head was going to be delivered on a platter.” He also inquired about an amount of money given to the informant. Under oath, Detective Thomas Kitch noted, “We contacted the Indiana State Police because our department is small. I know Charlie and most of our men are known throughout the community.” Kitch went on to assure the jury that it isn’t unusual for the department to call in state troopers. State police investigator Neal B. Graves stated during his testimony, “There wasn’t anyone on the county level who could work undercover as most of the officers were known to members of the community.” Kitch noted the informant said he had knowledge that up to $5,000 could be , made available through Crime Stoppers. An August 5,1986, copy of an ad which ran in the Warsaw TimesUnion was brought shown as evidence that $5,000 could be collected in drug related crimes. However, Crime Stoppers nor-

During the proceedings, Kosciusko County Police Captain Al Rovenstine, who was sheriff at the time of the arrest, explained that he gave $lO to the informant for gas on one occasion and $l4O for a bus ticket to Arizona at another time. When Stout inquired as to why money was given to the informant for personal needs, Rovenstine stated that the informant was having a number problems. Webster man found dead in Noble County
Noble County Police are still investigating the death of James C. McNeill, Jr., 24, r 1 Epworth Forest, North Webster, Saturday morning, Aug. 29. McNeill’s body was found on US 6 just west of CR 1050 W, one mile east of the NobleElkhart County Line, at 4:30 a. m. Noble County Sheriff’s Department reported a call was received from a person at a service station in Ligonier, at 4:30 a m. Saturday, stating there was a person lying in the road on U.S. 6. Noble Count Sheriff’s Deputy Don Leitch responded to the call and found McNeill’s body which had been struck by a vehicle and a semi. (Rovenstine), through the department, had given money from time-to-time to other informants when the need arose. The state called Michael J. Harman of the state police department and Kim Fazio, a chemist for the department, to testify concerning the controlled substance. Both witnesses conceded that their jobs require them to handle evidence. Fazio stated she personally tested the substance in this case. She conveyed, “The substances net weight was 27.5 grams and did contain cocaine.” The defense is expected to finish today (Wednesday) and a verdict may be in this evening.

There are no leads as to who initially hit the body. Police have learned McNeill had been at a bar in Ligonier where his wife was playing in a band. It’s believed his wife was not ready to leave when he was, so he began walking back to North Webster. Assisting the Noble County Sheriff’s Department and Deputy Leitch in the investigation are technicians from the Indiana State Police, Fort Wayne Post.
