Foundation gives free trees during January

The NationaF Arbor Day Foundation is giving 10 free trees to people who become foundation members during January. The free trees are part of the foundation’s -eff6rt to promote tree planting throughout America. A Sugar Maple, White Flowering Dogwood, Pin Oak, White Pine, Red Maple, Birch, American Redbud, Silver Maple, Red Oak, and Colorado Blue Spruce tree will be given to members joining during January. These trees were selected to provide benefits every season of the year: lovely spring flowers, cool summer shade, spectacular autumn colors, and winter berries and nesting sites for songbirds, according to the foundation. The six- to 12-inch trees will be shipped, postage paid, with enclosed planting instructions at tlje right time for planting this spring. The foundation makes its spring shipments between February 1 and May 31, depending on the local climate and this year’s weather. The National Arbor Day Foundation, a non-profit organization, is working to improve the quality of life throughout the country by encouraging tree planting. The foundation will give the 10 free

J. 7 14 NOTICE ORDINANCE 86-12-3 FLOOD CONTROL ORDINANCE the Town of Winona Lake has heretofore adopted a Flood Control Or dinance as Ordinance Numbered 85 7 2 of the Town of Winona Lake, and WHEREAS, the Board of Trustees of the Town of Winona Lake have now determined that the existing Flood Control Ordinance of the Town of Winona Lake is too restrictive, and WHEREAS, a Flood Control Ordinance within the Town of Winona Lake is necessary in order to qualify properties within flood areas for flood insurance under the Federal Flood Insurance Program, and WHEREAS, the Board of Trustees have developed a Flood Control Ordinance less restrictive than the existing Flood Control Ordinance and with language acceptable to the Federal Flood Insurance Program, and WHEREAS, the Indiana Legislature has by appropriate legislation granted the power to local units of government to control land use within their jurisdiction, NQW, THEREFORE, be it ordained by the Board of Trustee^ of the Town of Winona Lake, Indiana, as follows: Section 1. Statement of Purpose. The development of. the flood areas of the Town of Winona Lake, Indiana, could result in the potential loss of life and property, create health and safety hazards and lead to ex traordinary public expenditures for flood protection and relief. Since further develop ment of these areas is not essential to the orderly growth of the community and since a portion of these lands are suitable for open space uses that do not require structures of fill, it is in the best interests of the Town of Winona Lake, Indiana, to create certain flood plain districts. Section 2. Definitions. Unless specifically defined below, words or phrasesAised in this ordinance shall be interpreted so as to give them the meaning they have in common usage and to give this ordinance its most reasonable application. A. Development: any man-made change to improved or unimproved real estate in eluding, but not limited to buildings and other structures, mining, dredging, filling, grading, paving, . excavation or drilling operations. b. Flood or Flood Water: means the water of any river or stream in the state of Indiana or upon or adjoining any boundary lines of the state of Indiana, which is above the bank and/or outside the channel and banks of such river or stream; and also means the water of any lake which is above and outside the banks thereof. C. Flood Hazard Area: means any flood district as delineated by a numbered or un numbered Zone A on the Flood Insurance Rate Map (FIRM). D Flood Protection Grade: means the elevation of the lowest floor of a building or structure. If a basement is included, the basement floor is considered the lowest floor. Exception: If a commercial or in dustrial building is floodproofed as hereinafter defined, the term "flood protec tion grade" applies to the water surface elevation for which the building is protected E. Floodproofed: means a commercial or industrial building designed to exclude flood waters, from the interior of that building. All such floodproofing shall be adequate to withstand the flood depths, pressures, velocities, impact and uplift forces, and other factors associated with the regulatory flood. F. Natural Resources: means the Indiana Natural Resources Commission. G. Regulatory Flood: means that flood having a peak discharge which can be ex pected to be equaled or exceeded on the average of once in a one-hundred year period, as calculated by a method and pro cedure which is acceptable to and approved by the Indiana Natural Resources Commis sion. This flood is equivalent to a flood ;hav ing the probability of occurrence of one per cent in any given year. H. Structure: anything constructed or erected on the ground or attached to the ground, including, but not limited to, buildings, factories, shed, detached garages, cabins, mobile homes, and other similar items. Section 3. Establishment of Flood ‘ Districts. -k* A The Flood Hazard Areas (areas subject to flooding from the regulatory flood) have been identified by the Federal Emergency Management Agency on preliminary iSßbd way Flood Boundary Maps and Flood In surance Rate Maps prepared as part of the Winona Lake Flood Insurance Study. These preliminary maps represent the best available data and are the basis for the delineation of the flood hazard areas until the time these maps have been superceded by the final published maps complete with effective date. At that time, proceedings will be Instituted by the Town to modify the or dinance and this section to establish flood districts based upon the TTnal maps. Upon such final amendment and modification of this ordinance, the preliminary maps referred to hereinabove will then no longer be es fectlve. B Until such time that the preliminary maps prepared as part of the Winona Lake Flood Insurance Study have become effec five, as final maps, then for insurance pur poses only, the effective map to be used by lenders for making flood insurance require ment determinations as outlined in the 1973

Flood Disaster Protection Act will be the Flood Insurance Rate Map dated September 4, 1985. C. The Federal Emergency Management Agency, through the Kosciusko County Flood Insurance study which includes the Town of Winona Lake, Indiana, study, and which studies are dated February 4, 1987, has iden tified flood hazard areas in the Town of Winona Lake and in all parts of Kosciusko County, Indiana surrounding the Town of Winona Lake, with revised preliminary Flood Maps, which preliminary Flood Maps are now and shall continue through February 3, 1987, to be the Maps which are the subject of this Ordinance. Commencing February 4, 1987, the studies and Flood Insurance Rate Map identified In the first sentence hereinabove and dated February 4, 1987, as the effective date, shall become the Flood Insurance Rate Map and Flood Insurance Studies to , which this Ordinance shall apply. For determining Base Flood Elevations under this Ordinance, the Maps and Studies of the Federal Emergency Management Agency for the Town of Winona Lake, Indiana, dated July 2, 1986, shall com mencing February 4, 1987, become the Maps and Studies to which this Ordinance shall ap ply in determining Base Flood Elevations under this Ordinance. Those Base Flood Elevations and Studies of the Federal Emergency Management' Agency for Kosciusko County, Indiana, which are a part of or a basis of the Federal Emergency Management Agency, Flood Rate Insurance Map for Kosciusko County bearing effective date of February 4, 1987, are hereby made a part of this Ordinance to any property which hereinafter becomes a part of the Town of Winona Lake, Indiana, by annexation or otherwise. D. Commencing February 4, 1987, the foregoing paragraph (C) shall supercede and replace the foregoing paragraphs let tered (A) and (B), and any references in this Ordinance to any of th'e Maps, Studies or Base Flood Elevations represented by paragraphs (A) and (B) hereinabove shall, commencing February 4, 1987, be deemed to be references to the Maps and Studies adopted in paragraph (C) hereinabove, and all references in this Ordinance to preliminary Maps shall be construed on February 4, 1987, to be references to the Final Maps and Studies adopted in paragraph (C) hereinabove. E. The foregoing paragraphs (A) and (B) are being left in this' revised Ordinance, and the references to preliminary Maps' 1 and Studies are being left in this Ordinance at this time of reVision for the reason, that even after the passage of this Ordinance, those references and Maps will continue in effect and use with respect to this Ordinance until February 4, 1987, on which date the new Studies, Maps, Firms, and Base Flood Elevations adopted by this Ordinance shatl become effective. F. After. February 4, 1987, this Ordinance may be codified into a Town Code, with the language of paragraphs (A) and (B) hereinabove replaced with the words 'repealed" and the words "this Ordinance" replaced with "this Article" and "this Chapter" or "this Section" so long as there is much consistency in such changes that the meaning, import and requirements of this Ordinance are not charged, altered or modified. Additionally, the language of this paragraph may be replaced in any such con dification with the words "Transitional Pro visions." G The Flood Hazard Areas identified on the above referenced preliminary Flood Insurance Study Maps are comprised of the following districts for the purpose of this or dinance. I. Flood Plain District: The purpose of the Flood Plain District is to guide development in those areas for which detailed flood data has not yet been provided. This district in eludes the Flood Hazard Areas of: a. Wyland Ditch upstream of Park Avenue b. Keefer Evans Ditch upstream of the first upstream crossing of Lakeshore Drive c. Peterson Ditch upstream of Lakewood Avenue II Floodway District: a. The purpose of the Floodway (FW) District is to guide development in areas identified as floodway by the Indiana Department of Natural Resources. Natural Resources exercises primary jurisdiction in the Floodway (FW) District under the prgri sions of 1C 1971, 13-1-11; however, the Board of Zoning^Appeals of the Town of Winona Lake may impose terms and conditions on any permit it issues in this district which are more restrictive than those imposed by Natural Resources. Floodway Fringe District: The purpose of the Floodway Fringe District is to guide development in areas subject to potential flood damage, but out side an identified Floodway District. The FloodwayNFringe District may stand by itself or be combined with any other district. The principal requirement of this district is that the flood protection grade of all buildings shall be at least two feet above the regulatory flood profile. The Floodway Fr inge District includes portions of those areas delineated as numbered or unnumbered A Zones on the Flood Insurance Rate Map and determined by Natural Resources to be out side of the Floodway District of Wyland , Ditch, Keefer-Evans Ditch, Peterson Ditch, and above the legal lake level of Winona Lake. Section 4. Designation and Duties of the Administrator. The Building Commissioner for the Town of Winona Lake, Indiana, is hereby appointed to review all development and subdivision proposals to insure com 1 pliance with this ordinance. < Section 5. Administration. The Building Commissioner during the course of his review of all development and subdivision .proposals shall follow the following criteria: A. All permit applications for the develop ment of land or below the legal lake level of Winona Lake or located within the Flood Hazard Areas of Wyland Ditch, Keefer Evans Ditch, or Peterson Ditch shall be forwarded to Natural Resources in order to obtain the proper permit. No local permit may be issued until- a permit from Natural Resources has been received. All terms and conditions of Natural Resources shall be incorporated into the issuance of any local per mit. B. All permit applications for the develop ment of land located within the Flood Hazard Area of Winona Lake that lie on land above the legal lake level of Winona Lake do not re quire the formal approval of Natural Resources. In these areas all new construe tion and substantial improvements shall have the lowest floor (including basement) at or above an elevation of two feet above the regulatory flood elevation. C. All permit applications for the develop ment of land located within the Flood Hazard Areas of: I. Wyland Ditch upstream of Park Avenue, "tt. Keefer Evans Ditch upstream of the first upstream crossing of Lakeshore Drive, or 111. Peterson Ditch upstream of Lakewood Avenue shall be submitted to Natural Resources Natural Resources shall review the permit applications and grant a Floodway permit if warranted. If natural resources determines that the development location is not within their Floodway District jurisdiction, they will provide a letter of recommendation and the provisions of Section 5 (B.) will apply Section 6. Non-Conforming Uses. Any building, structure or other use in a Flood Plain (FP), Floodway (FW), or Floodway Fringe (FF) District which is not in confor mance with this ordinance constitutes a non conforming use. A. In a Floodway (FW) District, no non conforming use may be expanded or enlarg ed nor can a building undergo substantial modification without a permit tor construe tion in a floodway from Natural Resources B. In a Floodway Fringe (FF) District a building which constitutes a non conforming use may undergo substantial modnicatron provided such modification is on a one time only basis and further provided that such modification does not increase the value of the building by more than forty (40) percent of its pre improvement market value (ex eluding the value of land)' unless such building is permanently changed to a confor ming use. C. A non conforming use in a Flood Plain (FP) District may be altered, enlarged, or extended, on a one time only basis, provided the procedures set forth in this ordinance with respect to new construction in a Flood Plain (FP) District are followed and further provided such alterations, enlargements, or extensions do not increase the value of the building structure, or other use (excluding the value of land) by more than forty (40) percent of .its pre improvement market value, unless such building, structure, or use is permanently changed to a conforming use D. Any non-conforming use in the FP, FW, and FF Districts which is damaged by flood, fire, explosion, Act of God, or the public enemy may be restored to its original dimen sions and conditions, provided the damage does not reduce the value of the buildings, excluding the value of the land, by more than forty (40) percent of its predamage value Section 7. Variances. A. The Board of Zoning Appeals may con sider issuing a variance to the terms and provisions of the Floodway (FW), Floodway Fringe (FF), or Flood Plain (FP) Districts provided the applicant demonstrates that I. There exists a good and sufficient cause for the requested variance; 11. The strict application of the terms of this ordinance will cc nstitute an exceptional hardship to the applicant, and 111. The grant of the requested variance will not increase flood heights, create addi tional threats to public safety, cause addi tional public expense, create nuisances, cause fraud or victimization of the public, or s conflict with existing laws or ordinances. B. The Board of Zoning Appeals may issue L a variance to the terms and provisions of the Floodway (FW), Floodway Fringe (FF), or Flood Plain (FP) Districts subject to the following standards and conditions . I. No variance or exception for a residen tial use in a Floodway (FW) District may be granted; ■ 11. Any variance or exception granted in a Floodway (FW) District will require a per mit from Natural Resources. 111. Variance dr exception may be granted for the reconstruction or restoration of any structure listed on the National Register of Historic, Architectural, Archaeological and Cultural Sites, Structures, Districts, and Ob jects; VI. All variances shall give the minimum relief necessary and be such that the maximum practical flood protection will be given to the proposed construction; and > VII. The Bgard of Zoning Appeals shall issue a written notice to the recipiqnJ pf a variance or exception that the proposed construction will be subject to increased risks of life and property and could require payment of excessive flood insurance premiums. Section 8. National Flood Insurance Program Regulation. The Building Commis sioner, during his review of improvement location permits, shall assure that all NFIP regulations (contained in CFR 44, Chapter 60 3(d) and as specified on Attachment A (Section 8 Review Sheet for HF IP Regulations) which attachment is aftixed hereto and made a part of this ordinance by reference, pertaining to state and federal permits, sub division review, building permit review, flood proofing non residential structures, mobile home tie down standards, utility con struction, record keeping (including lowest floor elevations), and water course altera tion and maintenance have been met. Section 9. Disclaimer. Larger floods can and will occur on rare occasions. Therefore, this ordinance does not create any liability on the part of the community. Natural Resources, or the State of Indiana for any damages that result from reliance on this or dinance or any administrative decision lawfully made thereunder. Section 10. Emergency Clause. An emergency exists requiring the immediate passage of this ordinance. This ordinance shall be in full force and effect on and after itsjfcassage by the Board of Town Trustees, and publication as required by law. The Building Commissioner, during his review of improvement location permits, shall assure that all NFIP regula tions (cqntained in 44 CFR, Chapter 60.3(d) pertaining to State and Federal permits, sub division review, building permit review, flood proofing non residential structures, mobile home tie down standards, utility con struction, record keeping (including lowest floor elevations), and water course altera tion and maintenance have been met.
