NOTICE OF HEAR ING ON PROPOSED RATES TO BE CHAWED ST THE SYRACUSE MUNICIPAL. SEWAGE WORKS Property owners and other interested par ties ot the Town ot Syracuse, Indiana, are hereby notified that the Board of Trustees shall, at a special meeting to be held at 7:30 R.M. (EST) on Tuesday, December 9, 1986, at the Syracuse Town Hall, located at 500 South Huntington Street, Syracuse, Indiana, conduct and hold a public hearing on the matter of rates and charges for services to be rendered by the sewage works of the Town of Syracuse, and the adoption of an or dinance establishing such rates and charges, which said ordinance provides in part as follows: WHEREAS, the Board of Trustees of the Town of Syracuse has heretofore adopted Or dinance No. 78-21 on November 21, 1978, which is an Ordinance establishing rates and charges for the use of and services rendered by the sewage works of the Town of Syracuse, and WHEREAS, the Board now finds that said Ordinance should be changed, amended and supplemented relative to the rates and charges for the use of and services rendered by the sewage works of said Town in the par ticulars and as herei natter set forth and provided; now, therefore. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF SYRACUSE, INDIANA: Section 1. That all of the terms and provisions set forth and contained in Section 1 (a) through (i), inclusive, of said Ordinance No. 78-21 are hereby changed and amended, and the following terms and provisions shall hereafter be substituted in place of the cor responding parts now contained in said Sec tion 1 (a) through (i), inclusive, as follows:' (a) There shall be a fixed rate charge of 15.45 per month, plus rates and charges based on the quantity of water used on or in the property or premises served by such sewage system, as the same is measured by the water meter there in use. and shown by the consumption records of the water utility serving the Town and its inhabitants. (b) The sewage rates and charges fixed and imposed on the quantity of water usage shall be 11.75 per 1,000 gallons per month, (c) to the event a user of a municipal supply of water receives service on an unmetered basis then the Town shall base its charges on the flat rate charges as set forth in Section I (h) hereof. (d) The rates and charges fixed herein shall apply to lots, parcels of real estate or buildings located within the limits of the Town of Syracuse. For service rendered by said sewage works to lots, parcels at real estate or buildings located outside the limits of the Town of Syracuse, the rates and charges, including minimum charge, shall be one hundred fifty percent (150%) of those rates and charges established herein, and all other provisions herein se+Akit shall be applicable to such users located outside of Town limits. (e) For the service rendered to the Town of Syracuse said Town shall be subject to the same rates and charges hereinabove provided, or to charges and rates established in harmony therewith. (f) In the event two (2) or more dwelling units such as mobile homes, apartments ar housekeeping rooms discharging sanitary sewage, water or other liquids into the Towp's sanitary sewage system either directly or indirectly, are users of water and the quantity of water is measured by a single Water meter, then in such case billing shall be for a single service in the manner set out elsewhere herein, except that the minimum bill shall not be less than the number of such ■ dwelling units times 15.45 per month. In the case of mobile home courts, the number of dwelling units shall be com puted and interpreted as the total number of mobile home spaces available for rent plus other dwelling units served through the meter A dwelling unit shall be interpreted as a room or rooms or any other space or spaces in which cooking facilities are provided. (g) In order that the single family domestic and residential users of sewage service shall not be penalized for sprinkling lawns during the summer months of June, July, August and September the billing for sewage ser vices for residences and/or domestic users for said months may be based upon the water usage for the previous months of December, January, February and March. In the event the water usage for said previous months is greater than the water usage for said summer months, then the billing for sewage services may be computed on the actual water used in the month for which the sewage service bill is being rendered. Domestic and/or residential sewage service as applicable to the sprinkling rate shall apply to each lot, parcel of real estate of building which is occupied and used as a single family residence. Said sprinkling rate shall not apply to any premises which are partial - ly or wholly used for commercial or industriarpurposes. In the event a portion of such premises shall be used for com mercial or industrial purposes, the owner shall have the privilege of separating the water service so that the residential portion of the premises is served through a separate meter and in such case the water usage as registered by the water meter serving such nortion of the premises used for residential pur poses would qualify under the sprinkling rate. A user desiring computation of charges for ’he months of June, July, August and September be made in ac. cordance with the sprinkling rate shall notify the Clerk Treasurer of Town on or before the first day of the month for which such computation is requested. (h) For users of sewage services who have a private supply of water or have a municipal supply of water that is unmetered, or in the event a significant portion of the water used on or in the premises is not returned to the Town's

In such event, the charges for sewage services shall be based upon rates and charges as set forth in Section 1 (a) and (b) (i) In the event the Town shall agree to allow and permit the dumping and discharge of normal domestic wastes into the sewage works by persons engaged in the cleaning of private domestic septic tanks, there is hereby fixed and imposed for each and every such dumping and discharge a minimum charge in the amount of 15.45 plus the rates and charges as set forth in Section 1 (b) shall be applied for the volume of waste being so dumped and discharged into the sewage works. Section 2. Except as herein expressly changed, amended and supplemented all other terms, provisions and matters set forth and contained in said Ordinance No. 78-21 remaininfull force and effect. Section 3. This Ordinance shall be in full force and effect from and after its passage. At such hearing and prior to final adoption ■of said ordinance, all interested parties may appear and be heard. A copy of such propos ed ordinance is on file in the office of the Clerk Treasurer and available for inspection by any interested parties during regular business hours.
