Things to consider when joining a spa

With a new year just beginning, many people plan to loose weight and get into shape, says Attorney General Linley Pearson. If you are one of those trying to reduce the bulge around your middle or firm your figure, you may be considering joining a health spa or fitness club, he said. There are certain things to consider when choosing a health spa, he said. “There are a number of fine health spas, but some consumers have learned the hard way that they’ve joined the wrong one when it closes a few months after they purchased a membership,” the attorney general said. It’s important to check the reputation of the spa’s parent company, he advised. Find out how long it has been in business and if there are any unresolved consumer complaints at the local Better Business Bureau or with the attorney general’s Consumer Protection Division. “We received more than 300 complaints about health spas in 1965. Most of those complaints concerned health spas that closed after consumers purchased memberships in the facilities,” Pearson said. “Our office recently filed suit against an Indianapolis health spa operation after it closed one facility that had been open about 18 months and never opened a second facility for which memberships were sold,” Pearson added. The suit charges the owners with violating Indiana’s deceptive sales and health spas laws. Consumers who decide to join a health spa or club, should visit the facility several times before buying a membership, Pearson advised. “Note whether your preferred hours coincide with peak times. If so, you will want to see whether the club is crowded. If it is, you might find it difficult to use the equipment or pool,” Pearson said. Consumers should pick a club that’s convenient to their home or office, the attorney general said. “Chances are you are less likely to use a spa if you have to drive a longdistance.” Take advantage of the free introductory sessions that many

Talk to a few members and see if they are satisfied with the spa’s staff and upkeep. ” Beware of hardsell tactics by spa employees, Pearson warned. “If you feel any undue pressure to sign immediately, or if you are not allowed to take the contract home with you before signing it, don’t join.” Consumers should find out exactly what a health spa membership includes before they sign a contract, the attorney general said. If the salesperson promises something that is not in writing, get that promise in writing. Verbal promises are worth very little when a written contract is involved, he added. Consumers with health problems should check with the doctors about what kinds of exercise are best for them before joining a health spa, Pearson said. Under Indiana law, a contract for health spa services must be in writing, and the term of the coif tract may not exceed three years from the date it is entered into, Pearson said. In addition, health spa cootracts may be cancelled by the consumer before midnight of the third full business day after the consumer signs it, Pearson said. A consumer may cancel the contract by written notice, in any form, delivered in person or mailed by certified or registered mail to the address specified in the contract, the attorney general said. Any money paid pursuant to the contract must be refunded within 30 days of receipt of the notice of cancellation, he added. Consumers with questions or complaints about fitness centers may call the attorney general’s Consumer Protection Division toll free, 1-800-382-5516. Lay-offs MIAMI — Eastern Airlines said that it would lay off 1,010 flight attendants and cut the pay and privileges of the remaining 6,000 to ward off creditors’ threats to declare default on its $2.5 billion debt.
