NOTICE ORDINANCE NUMBER 85-7-1 ORDINANCE RESTRICTING USE OF FIRE STATION PROPERTY WHEREAS, the Board of Trustees of the Town of Winona Lake, Indiana have heretofore entered into a certain ninety nine (99) year lease of real estate from the Free Methodist Publishing House, which lease agreement was approved by the State Board of Tax Commissioners on or about the 25th day of June, 1984, and which lease has heretofore been recorded in the Office of the Recorder of Kosciusko county, Indiana, and WHEREAS, pursuant to said lease, the Town of Winona Lake, Indiana agreed to restrict the use of a certain access drive in connection with said real estate being leased, and WHEREAS, said real estate which is the subject of the above referenced lease has been improved for use by the Volunteer Fire Department of the Town of Winona Lake, Indiana, and WHEREAS, in order to comply with the lease agreement of the Town, and WHEREAS, the Board of Trustees of the Town of Winona Lake, Indiana have deter mined that it is important to prevent a dedication to public use with respect to said real estate, and WHEREAS, the Board of Trustees of the Town of Winona Lake, Indiana have deter mined that it is important to the safety and welfare of the Town that the functions of the Volunteer Fire Department of the Town of Winona Lake, Indiana and the use of the improvements upon said real estate are not impaired by the congestion of traffic. diana or any of their deputies may upon application from any person execute and deliver a written permit for the use of the real estate described In Section 2 hereinabove, which permit shall state the purpose and the length of time for which the permit is effective, but no such permit shall be given unless such person has first demonstrated to said Clerk Treasurer or Town Marshal the following: a. That there is specific and justifiable need for person to use said real estate other than for personal use and enjoyment, and b. The use being requested is not merely for the purpose of driving between the two streets connected by said real estate, and c. The need for such permit being requested is somewhat emergent in nature. In the event that the Town Clerk Treasurer or the Town Marshal of the Town of Winona Lake, Indiana should refuse to issue a permit, such person may appeal to the Board of Trustees of the Town of Winona Lake, Indiana at its next regular public meeting. 4. It shall be unlawful for any person to use the real estate described in Section 2 hereinabove for any purpose, including but not limited to driving thereon, unless such person has a right to use said strip of real estate as is provided in Section 2 hereinabove. 5. Any person who does not comply with Sections 1 or 2 of this Ordinance, or whom otherwise violates Sections 1 or 2 of this Ordinance, shall be subject to a fine of 55.00 for each violation together with the attorneys fees of the Town incurred in enforcing the provisions of this Ordinance, which fine and attorneys fees shall not exceed 52,500.00 for each violation. Notwithstanding the foregoing, the Town Marshal may permit any per son violating any of the terms of this Ordinance a period of time not to exceed two (2) weeks to make payment of the fine directly to the Clerk Treasurer of the Town of Winona Lake. _ 6. This Ordinance shall be in full force and effect upon its passage and publication as required by law.
