APC denial stands as is
By GARY LEWIS After reviewing a case sent back by the Kosciusko County Commissioners, the area plan commission refused to reverse an earlier decision denying a rural North Webster man’s petition to rezone his property light industrial for his welding, repair and light fabricating business. Robert Williamson, r 1 Warsaw, appeared before the APC in October .to review the case. The commissioners unanimously denied the petition, saying to do otherwise would be “spot zoning" and cited several violations of the home occupation special exception regulations. The property is located on the east side of SR 13, one-half mile north of CR 400 N, south of North Webster. The APC determined Williamson violated restrictions on the size of his business sign and did not keep his equipment inside. The home occupation special exception is designed to allow for small businesses in residential or agriculture zoned areas if the exterior is kept free from clutter and conforms to the surrounding property. Williamson appealed the decision to the county commissioners who in turn sent back the petition to the APC. The APC upheld its earlier denial and recommended the case be heard by the Kosciusko County Board of Zoning Appeals. Neer Acres Tabled In the only case on the agenda, the APC tabled a petition by county health nurse Barbara Clouse for preliminary plat approval for Neer Acres. The residential subdivision would be located on the west side of the Syracuse-North Webster Road, south of Woodland Acres Drive. Area Planning director Dan Richard said the case has a “unique twist” because a onefoot strip of land on the north side of the property, located along the south side of the Woodland Acres Drive, is owned by someone else. The Woodland Acres Drive is the only access for two of the lots of the subdivision. The strip of land is owned by Woodland Acres and was purchased to protect the subdivision from unwanted neighbors, explained Howard Juday, co-owner of Woodland acres. He told the commission Three autos in accident A mishap on SR 13 at CR 550 N recently involved three autos with damages under $6,000. Delories J. Long. 35, r 1 North Webster, had stopped to make a left turn onto CR 550 N when her auto was struck from behind by a .car driven by John D. Heckaman. 19, r 4 Syracuse. Heckaman had slowed for the Long vehicle when he was rearended by an auto driven by Leia J. Achey, 52, r 1 Leesburg. Heckaman s auto was pushed into the Long auto. The Leesburg and Syracuse autos were damaged up to $2,500. The North Webster vehicle sustained less than S2OO damage.

members that he has no quarrel with Neer Acres, but his wife, coowner of the strip, refused to give up title to the property by filing a quick-claim deed. The only other issue questioned in the case was an alleged drainage problem. Syracuse attorney Steven Snyder, representing a neighbor to the proposed subdivision, said a pond 25 to 30 feet in radius forms every time there’s a rain of one-inch or more. He said a culvert, located underneath the SyracuseWebster road, is not located in the center of the drainage area which extends all the way south to the Crazy-Corners intersection. Chuck Brower, APC member, said the county highway department has been aware of the problem and a culvert was to be installed over a year ago. The board unanimously approved to table the issue until the one-foot strip of property along the road is clarified.
