Lozano guilty of unauthorized control of rifles

Noe E. Lozano, 27, 119 West Portland Street, Syracuse, was found guilty of gaining unauthorized control of two rifles belonging to James Benson following a jury trial in Kosciusko Circuit Court on Monday, July 23. Judge Gene B. Lee presided over the trial. The rifles were stolen from the home of Warren Benson, r 2 Syracuse, in October 1978. James Benson, 22, of Syracuse, was called to the witness stand and identified the two rifles that Lozano allegedly had control over. Jeffery Wayne Slough, 17, formerly of Syracuse, was then called to the witness stand. Slough is presently serving time in the Indiana Youth Center for the theft of the guns. He testified on the events of October 24, 1978, when he and another juvenile broke into the Benson home and took three guns and a filing cabinet. The two youths took the guns to Lozano, who allegedly agreed to sell the guns in return for either SIOO or a quarter pound of marijuana whu?h is valued at about $l2O. The received payment fpr the guns according to who testified that Lozano told him he had been in an accident with* a van and the weapons had to be thrown in the river. New labels on gas pumps

After June 1, there should be posted on gas pumps yellow labels that read like this; Minimum Octane Rating — (R+M)-2 Method - 89.5. That is not the price, it is telling you the octane rating. This label is required by the Federal Trade Commission, and is important since it measures how well the gasoline will prevent engine knocking. Engine knock, ping or rattle is caused by uneven burning of gasoline in the engine. This happens when the gas has an octane rating too low for your car. Although there are other factors in gas that are important to consumers, such as additives to clean internal parts or to help the car start in cold weather, the FTC has found that many consumers are overbuying gas — that is, buying gas with a higher octane than they need . . . by Slough, Lozano knew the guns were stolen. When Attorney William M. Dalton questioned the youth about the statement, he replied that he was drunk. When asked if he were drunk on the date of the statement, December 13, the boy answered he might have been. Testimony showed that on the day of the alleged break-in, the two boys had consumed nearly eight beers from morning until mid-morning when the break-in occurred. The alcohol had apparently affected Slough to the point he could not recall many incidences that occurred that day. Many of the missing parts of the day were filled in by testimony of other persons, including that of the other juvenile, who is serving time at the Indiana Boy’s School for a string of burglaries. Lamar Huber, 402 North Madison Street, Nappanee, explained how he purchased the two rifles from Lozano and how Lozano assured him the rifles were not stolen property. When he learned they were stolen, the Nappanee businssman confronted Lozano who said if he could get a job he would pay him back. He also told the Nappanee man that he had received the guns from two juveniles who had broken into a house. Patrolman Kitch recalled his

energy and the additional lead found in higher octane leaded gas just adds to air pollution. Check the octane rating on the gas you are buying now. If the car is not knocking, fill up the next time with the next lower octane. If it still doesn’t knock, try one level lower. part of the investigation for the state. Charles Cobum, 28. was called to the stand on behalf of the defendant. Coburn, now at the Indiana State Reformatory at Pendleton for parole violation, told the juveniles how they could find Lozano's apartment and then followed them there. He said Lozano asked him if the guns were stolen and he replied with the statement the boys had allegedly told him, that they were selling the guns for a friend who was in jail. He admitted the two men had lied to the boys.. He gave two reasons: One because he was on parole and could not be caught with guns at any second because they were not going to give the boys any money. Lozano was called to testify on his own behalf. He stated he was not sure that the guns were stolen and the first time he knew of it was when Huber told him they were. „ In cross examination Lozano admitted he lied on the statement he gave at the time of his arrest on December 12. He stated he had only sold two guns to the Nappanee man. Later he admitted to selling all three of the guns that had been stolen from Benson to Huber. When confronted as to why he told the boys that the guns were in the river and asked if he intended to steal the guns, Lozano replied that the wanted to see how the boys would react. After a deliberation time of almost 20 minutes, the jurors returned with a verdict of guilty. The judge set sentencing for August 9, at 9a.m.. and raised the bond from $2,000 to $20,000 Lozano was remanded to custody of the sheriff in lieu of bond. SSOO damage as cars collide A vehicle driven by Amelia J. Becker, 66. f 2 Syracuse, collided with an auto operated by Julie A. Byland, 19, r 4 Syracuse, Saturday, on Old Road 13A, three miles southeast of Syracuse Becker was backing out of her driveway and failed to see Byland's car. She said her vision was obstructed by the bushes at the end of her driveway. Byland, traveling northbound on Old Road 13A, swerved her vehicle to the left but not in time to prevent the accident. Damage to the Becker auto was estimated at S2OO and to the Bvlandcar. S3OO.
