A recent report by the Department of Health, Education and Welfare revealed that the federal government — the institution with the primary responsibility of enforcing the 1964 Civil Rights Act — is guilty of discriminatory practices in its administration of the Social Security Act. The HEW report, entitled ‘Social Security and the Changing Roles of Men and Women,” included discussions of the discrepancies of benefits between one and two-earner married couples with the same earned incomes, the injustice of married working women not receiving additional benefits for the money they have paid into Social Security, and the denial of disability benefits for disabled life-long homemakers. In 1939, before Social Security benefits were first paid, supplementary protection was provided for workers’ wives and widows as dependents. This method of providing dependents’ benefits reflected a pattern of American family life in which the husband was the sole financial provider and the wife was a lifelong homemaker. Today, the labor-force participation of married women has grown to more than 47 per cent, as compred to 17 per cent in 1940. The increase in the divorce rate has also contributed to the growing diversity of family roles and work patterns, since many divorced women must work to support themselves and their families. Two years ago, in response to these changes in our society. Congress directed HEW to study the treatment of women under Social Security. The central issue involved is whether the system of dependents’ benefits, designed decades ago, adequately serves today’s society. The present system favors lifelong married couples in which only one spouse is a life-long paid worker. For example, a oneearner married couple with a monthly earned income of SI,OOO would receive a benefit of $648, while a two-earner family with the same family income could receive as little as $544. Current methods of computing Social Security benefits discriminte against women who work outside the home. The benefits a working wife earns merely duplicate her husband's benefits instead of supplementing them. Working
women are denied earned must rely primarily on their husbands' dependents’ benefits. One approach to eliminating certain discriminatory practices under Social Security is the earnings sharing option. Under this proposal, a couple’s annual earnings would be divided equally between them for the years they are married for purposes of computing retirement benefits. This approach would give homemakers their own earned benefits, and allow working women to benefit from the money they pay into Social Security. The earnings would be divided when the couple divorced or when one spouse reached age 62. This would entitle each spouse to a primary benefit which would replace aged dependent spouses’ and surviving spouses’ benefits under current law. The earnings sharing option would also improve the protection of married women who spend time out of the paid labor force in childcare and homemaking activities. In addition, it would help prevent gaps in protection for divorced women as each spouse would have protection in his or her own right Homemakers sharing equal responsibilities in American families should be given credit for their contributions, and working women must not be denied benefits for which they have paid. It is the duty of Congress to responsibly address the problem of discrimination in Social Security ana to develop effective legislation which will treat all Americans equally.
