LEGALS NOTICE OF HEARING ON PROPOSED RATES TO BE CHARGED BY THE SYRACUSE MUNICIPAL SEWAGE WORKS Property owners and other Interested parties of the Town ot Syracuse, Indiana, are hereby notified that the Board of Trustees shall, at its regular meeting to be held at 7:30 P.M. (EST) on Tuesday, November 21, 1978, at the Syracuse Town Hall, located at 500 South Huntington Street, Syracuse, Indiana, conduct and hold a public hearing on the .matter of rates and charges for services to be rendered by the sewage works of the Town of Syracuse, and the adoption of an ordinance establishing such rates and charges, which said ordinance provides in part as follows: Section 1. General Sewage Rates For the use of and the service rendered by said sewage works, rates and charges shall be collected from the owners of e|ch and every lot, parcel of real estate or building that is connected with the Town's sanitary sewage system or otherwise discharges sanitary sewage, industrial wastes, water or other liquids, either directly or indirectly, into the sanitary sewage system of the Town of Syracuse, which rates and charges shall be payable as hereinafter provided and shall be in an amount determinable as follows: (a) The sewage ratesand charges shall be based on the quantity of water used on or in the property or premises served by such sewage system, as the same is measured by the water meter there in use. and shown by the consumption records of the water utility serving the Town and its inhabitants. (b) The water usage on which the amount of said sewage rates and charges shall be determined and the rates and charges shall be as follows: Quantity of Water Rate Per Used Per Month 1,000 Gallons First 2,500 gallons 52.10 Next 17,500 gallons 1.68 Next 40,000 gallons 140 Next 90.000 gallons 112 Over 150.000 gallons 84 The minimum monthly charge for sewage services shall be based upon the water meter in use on the premises as follows: Monthly Size Water Meter Minimum Charge $ 5.25 V 16.80 IV.” 25 20 11,” 33.60 2 " 49.00 3" 98.00 4" 140.00 4 ” 259.00 (c) In the event a user of a municipal supply of water receives service on an un metered basis, then the Town shall base its charges on the flat rate charges as set forth in Section 1(h) hereof. In no event shall such charges be less than $7 00 per month. (d) The rates and charges fixed herein shall apply to lots, parcels of real estate or buildings located within the limits of the Town of Syracuse For service rendered by said sewage works to lots, parcels of real estate or buildings located outside the limits of the Town of Syracuse, the rates and charges, .including minimum charge, shall be one hundred fifty percent (150%) of those rates and charges established herein, and all other provisions herein set out shall be ap plicable to such users located outside of the Town limits. (e) For the service , endered to the Town of Syracuse said Town shall be subject to the same rates and charges hereinabove provided, or to charges and rates established in harmony therewith. (f) In the event two (2) or more dwelling units such as mobile homes, apartments or housekeeping rooms discharging sanitary sewage, water or other liquids into the Town's sanitary sewage system, either directly or indirectly, are users of water and the quantity ot water is measured by a single water meter, then in such case billing shall be for a single service in the manner set out elsewhere herein, except that the minimum bill shall not be less than the number of such dwelling units times $5.25 per month. In the case of mobile home courts, the number of mobile home spaces available for rent plus any other dwelling units served through the meter A dwelling unit shall be interpreted as a room or rooms or any other space or spaces in which cooking facilities are provided. (g) In order that the single family domestic and residential users of sewage service shall not be penalized for sprinkling lawns during the summer months of June, July. August and September the billing for sewage service for residence and or domestic users for said months shall be based upon the water usage for the previous months of December, January, February and March. In the event the water usage for said previous months is greater than the water usage for said summer months, then the billing for sewage services shall be computed on the actual water used in the month for which the sewage service bill is being rendered. Domestic and or residential sewage service as applicable to the sprinkling rate shall apply to each lot, parcel of real estate or building which is occupied and used as a single family residence. Said sprinkling rate shall not apply to any premises which are partially or wholly used for commercial or industrial purposes. In the event a portion of such premises shall be used for commercial or industrial purposes, the owner shall have the privilege of separating the water service so that the residential portion of the premises is served through a separate meter and served through a separate meter and in such case the water usage as registered by the water meter serving such portion of the premises used for residential purposes would qualify under the sprinkling rate. In such event, the charges for sewage services shall be based upon rates and charges as set forth in Section 1(b) . (i) In the event the Town shall agree to allow and permit the dumping and discharge of normal domestic wastes into the sewage works by persons engaged in the cleaning of private domestic septic tanks, there is hereby fixed and imposed for each and every such dumping and discharge a minimum charge in the amount of $2.00 plus the rates and charges set forth in Section Kb) shall be applied for the volume of waste being so dumped and discharged into the sewage works Section 2. In order that the rates and charges may be justly and equitably ad justed to the services rendered, the Town shall base its charges not only on the volume, but also on the strength and character of the sewage and wastes which it is required to treat and dispose of. (a) The Town shall have the right to measure and determine the strength and content of all sewage and waste discharges, either directly or indirectly, into the Town's sanitary sewage system, in such manner and by such method as it may deem practicable in the light of the conditions and attending circumstances of the case in order to determine the proper charge (b) Extra charges based on the strength of the sewage and liquid wastes shall be made on the following basis: -1. Rate Surcharge Based Upon 800 For each measured pound of Biochemical Oxygen Demand in excess of normal domestic waste of 200 milligrams per liter of fluid, there shall be an additional charge of 8 cents per pound. 2. Rate Surcharge Based Upon Suspended Solids For each measured pound of suspended solids In excess of normal domestic waste of 250 milligrams per liter of fluid, there shall be an additional charge ot 8 cents per pound. (c) To determine the strength of the sewage and wastes, samplings and analyses shall be made from time to time whenever it is deemed desirable by the Town. After charges have been established based upon the strength of sewage and wastes, the owner may request reconsideration of these charges by the Town by submitting analyses of composite samples of the sewage and wastes subject to such charges, certified by a Registered Engineer or a qualified graduate chemist. The Town may then adjust the charges to the ordinance rates required by such analysis or may rechecl he findings by additional samplings and analyses. The determination of Suspended Solids and Five-day Biochemical Oxygen Demand contained in the waste shall be in accordance with the latest copy of "Standard Methods for the Examination of Water, Sewage and Industrial Wastes", as written by the American Public Health Association, the American Water Works Association and the Water Pollution Control Federation. At such hearing and prior to final adoption of said ordinance, all interested parties may appear and be heard. A copy of such proposed ordinance is on file in the office of the Clerk-Treasurer and available for inspection by any interested parties during
