Mrs. Lillie Rosbrough. *I,OOO damages in rear-end crash A two-car accident resulted in over SI,OOO in damages at the intersection of South Huntington Street and Railroad Avenue, Syracuse, at 1:55 a.m. Saturday, July 30. Glenna C, Weston, r 1 box 121A Nappanee, was driving north on South Huntington Street when she was hit in the rear by Jerry D. Whetten, 11788 Breezy Point, Plainwell, Mich. Weston was attempting to make a left turn onto Railroad Avenue when the accident occurred. Damage to the Weston car,
owned by Sherri DelaFuente, box 609 Milford, was set at $650. Damage <rf S7OO was estimated for the car driven by Whetten, which is owned by Paul A. Vos, r 1 box 72 Milford. Cars bump orcurve Stanley F. Roberts. 70, r 1 North Webster and Dennis L. Coverstone, 16, r 1 Larwill, were involved in a two-vehicle collision Monday, August 1, at 11:45 a.m. on CR 850 East, one mile east of North Webster The vehicles bumped as they rounded a curve on Yellow Banks Drive. Damage was set at $450 to the Roberts car and S3OO to the Coverstone auto. Frustration is not having anyone, to blame but yourself.
Dredging suit filed in circuit court
The following suit was filed in Kosciusko Circuit Court last Saturday by Attorney General Theodore L. Sendak, concerning dredging on Lake Wawasee and asking for it to cease. Preliminary and Permanent Injunction Comes now plaintiff by Joseph D. Cloud, director, by Theodore L. Sendak in his official capacity as Attorney General, and for its complaint and cause of action against Defendants alleges and says as follows. 1. The Plaintiff, by and through the Indiana Department of Natural Resources, statutory successor of the Indiana Department of Natural Conservation, pursuant to 1C1971,13-2-11-1 et seq. is charged with the authority to control for public enjoyment all public fresh water lakes in the State ot Indiana, and hold and control all lakes in trust for the use of the citizens of this State for fishing, boating, swimming, the storage of water and for other purposes. 2. The Plaintiff, by and through the Indiana Department of Natural Resources, authorized, empowered and charged by IC 1971, 13-2-14-1 et seq. with the duty to protect and preserve the water resources, the natural resources, and the natural scenic beauty, and the general protection of these and all other vested rights of the citizens of the State. 3. The Plaintiff, by and through the Indiana Department of Natural Resources, is empowered and authorized to bring and maintain this action by IC 1971, 13-2-11, 12 and 14 each thereof. 4. Defendants, Richard C. Ver Wiebe and Mary L. Mason, are the owners of real estate located in Kosciusko County, State of Indiana, more particularly described in the copy of the deed marked as Exhibit “A” which is attached hereto and made a part hereto by reference. 5. The above described property borders on a portion of Lake Wawasee, a public fresh water lake within the meaning of IC 1971,13-2-11 and 14 and located wholly within the boundaries of Kosciusko County, Indiana. 6. The normal water level of Lake Wawasee was established by this court on September 20, 1948 at 858.89 feet elevation, sea land datum, or at 8.89 feet as shown on the staff water gauge of the US Geological Survey, Cause No. 24976. 7. Ind. Code 13-2-11-2 directly provides: It shall be unlawful for any person to extend the shore line of meandered or unmeandered public fresh water lakes in Indiana by excavating or by filling or depositing into the waters of any such lake soil, earth, gravel, sand, stone, or any other substance for the purpose whatsoever. In meandered and unmeandered public fresh water lakes accretion rights shall be limited to such lands from which the waters of such lakes have receded from or may. recede from natural causes only, and no accretional rights shall accrue to any reparian landowner by the lowering of any such lake level by drainage or by extending the shore line out into the waters of any such lake by filling thereof with soil or any other substance of any kind or by extending the shore line away from any such, lake by excavating, dredging or, channeling through the shore line and the drainage or filling of any such lake is hereby declared to be unlawful . . (emphasis added) 8. Ind. code 13-2-11-5 further provides, the Indiana department of conservation (natural resources) is hereby authorized and empowered to bring in any court of proper jurisdiction acCrossings to< be closed Railroad crossings in Syracuse will be closed most of the day Monday, Aug. 8. Bob Biank. supervisor for the Baltimore and Ohio Railroad said the three crossings in Syracuse will be closed due to the replacing and welding of new rail on the tracks. The crossings will be closed beginning at 6 a.m., with maybe one or two crossings being opened late in the day, Biank added.

tions byway of injunction, either prohibitive or mandatory, or both, by separate paragraphs in the same complaint against any person violating any of the provisions of this act (13-2-11-1— 13-2-11-6)/ The Plaintiff in such cause shall not be compelled to give bond, and from and after the filing of such action and service of notice all matters involved in such action shall be held in abeyance until such action can be tried and determined. Should any defendant continue drainage or filling of public fresh water lakes, as above set out, after the service of notice to the aforesaid action and before trial thereof, the plaintiff shall be entitled upon a verified showing of such acts in (on) the part of the defendant, to a temporary restraining order without- notice which shall be effective until said cause has been tried and determined. 9. Ind. code 13-2-14-5 also further provides: It shall be unlawful for any person, firm, corpora tibn, board of county commissioners, body of viewers, or drainage commissioners to enroach upon the lake level of the water or shore line of such lakes as now ekist, in law or in fact, by excavating, filling in, or otherwise causing a change in the size or affecting the natural resources, scenic beauty and contour of such lake below the water line or shore line, without first securing the written approval of the Indiana department of conservation (natural resources): Provided, however, that as a prequisite to the e granting of a permit to extend and-or alter the shore line of the lake by excavating, dredging or channeling and thereby creating additional water area which will be connected to the lake, the applicant shall dedicate any and ail such water thus created to the general public use. (emphasis added)] 10. The Defendant, John Mason, was observed to be directing the dredging of the lake bed of Lake Wawasee by use of a drag lihe on April 2,3, and July 28, 29, 1977. 11. Such above described operation of a drag line was being conducted below the legally established lake level of Lake Wawasee. 12. Defendants have not obtained any payment whatsoever from Plaintiff, Department of Natural Resources, to conduct such activity in Lake Wawasee. 13. ,Such above - described operation of a drag line constitutes such an excavation, dredging and channeling through the shore line prohibited by Indiana code 13-2-11-2. 14. Such above described operation of a drag line constitutes an excavation, filling in, or otherwise causing a change in the size or affecting the natural resources, scenic beauty and contour of such lake below the water lineeor shore line, without first; securing the written approval of the Department of Natural Resources, prohibited by Ind. {code 13-2-14-5. 15 Plaintiff will be irreparably harmed unless Defendants are enjoined and Plaintiff has no adequate remedy at law. Wherefore, Plaintiff prays that the Defendants and each of them and all persons acting through theiji be enjoined from operating any (drag line, or other device, in the waters of lake bed or Lake Wawasee.
