Delay action on Byrd petition tor fourth time

The plat presented was for a subdivision and preliminary plat, as a commercial area in the original planned unit development, has been dropped. Presenting the petition for Byrd was Attorney Richard Ver Wiebe. Ver Wiebe pointed out existing trees in the 3,000 foot wide corridor, asked to protect 1 the runway of the Wawasee Airport, are taller than any home which would be constructed. Growth lawsuits reason for joining area plan
By LESLIE WHITMAN The Syracuse Town Board two weeks ago decided unanimously to join the Town of Syracuse and Turkey Creek Township with the County Area Plan Commission to be effective August 1. Due to the controversy over why this decision was made, several members of the town board' have decided to voice their views. Town Board President James C. Tranter said there were several reasons why he felt this decision should be made. The major reason he cited was growth. He said, “you can’t stop growth in any area and be successful about it.” He stated there has been a conflict between the town board and

Syracuse Chamber board opposes action of Syracuse Town Board The Syracuse-Wawasee Chamber of Commerce board of directors went on record last Thursday as opposing a recent action of the Syracuse Town Board in dissolving the Syracuse Plan Commission and turning Syracuse and Turkey Creek Township over to the jurisdiction of the Kosciusko County Area Plan Commfaston. (Note: An explanation ob the Syracuse Town Board’s position in this matter appear* at the top of this page.) The full text of a statement released by the chamber of commerce to as follows: t • The board of directors of the Syracuse-W’awasee Chamber of Commerce strongly opposes the action and manner of action taken at the last meeting of the Syracuse Town Board. Helmet law has not been repealed, cycle riders must wear headgear
State Senator John B. Augsburger of Milford told MailJournal representatives this week the helmet law, which was to have been repealed on July 1. is still in effect. The helmet law will, when it becomes law, allow motorcycle riders to ride without helmets. At the present time it is against the law fa* anyone to be on a moving motorcycle without the proper headgear. Augsburger said it was the intent of the legislature to repeal

The final reason Tranter stated was that he has heard from the townspeople that they have taxation without representation. He said the board has been working on the ordinance and map for approximately nine months and haven’t' given enough time to other town matters. Date Change The board originally agreed to join the area plan commission July 7 and then changed the date to August 1 at a meeting on July 5. The reason the town board president said this was done was because of the area plan commission s mobile home park ordinance. ? He said, “we don’t feel the county has a strong enough mobile home ordinance”. The board decided to wait an additional 30 days before
the law as of the July 1 date, however, the law has not yet been promulgated (put into effect by publishing its terms) in the various counties of the state and therefore the old law is still in effect. While some areas are not arresting riders who are on the roads without the headgear required by the law, others are continuing to uphold the old law until the new one becomes law bypassing the proper channels.

He didn’t make any comment about if the date would be moved back any further or not. Concerning whether the board gave the commission enough time to clear its records before joining the county Tranter said he felt the 30 day extension was sufficient. He said this even though both William Beemer, Syracuse Plan Commission president, and Jack Lawson, Syracuse Plan Commission attorney, have said they will be taking vacations within the 30 day time period. Bill Coburn, a Syracuse resident, spoke, saying the sewage system in that area doesn’t work because of the level of the lake. He said he was given a petition to sign for the airport. “We need that airport,” Cobum said. “It’s an asset.” Coburn continued, the airport runway has been changed within the last five years and said if a pilot had any psychological feelings about flying over children, he shouldn’t be in a plane. Lawson told the commission ? when the ordinance passed by the town board he requested 90 days to give all zoning and other materials to the commission. Hopefully, Lawson said, he will request the Syracuse Town. Board delay the action for another 30 days, as he and plan commission president Bill Beemer will be out of town for several weeks. The slight, bespectacled youth admitted to entering the James street home of Mr. and Mrs. Arch Baumgartner, gaining entrance ' through a dinette window and taking approximately $125 in in cash and Mrs. Baumgartner’s billfold containing valuable I personal contents. Brown also admitted to entering the offices of Little & Clark Insurance Agency on Road 15 last Tuesday night or early Wednesday morning. According to Bill Little, the culprit took about S4O in cash located in several different places in the office, and rifled through the office but taking nothing of value. The same night of the Little & Clark entry, a big Doberman Pinscher watch dog at the Paul , Stef fan home on Emeline Street in Milford frightened a would-be burglar at about 3:30 a.m. (Continued on page 2)
