Army corps of engineers now controls all waterways
As of July 1, a change has come about in the control of all United States waterways. Effective July 1, the US Army Corps of Engineers has control over all waters in the nation. But, from a local point of view, what effect this will have on developers in the Lakeland area remains to be seen. The army corps already has had enforcement and permit powers over some of the waters. In 1975, the corps began requiring permits for dredge and Till operations affecting all coastal waters, inland navigable waters and nearby wetlands. Then, in 1976, they took charge of all primary tributaries of inland navigable waters, nearby wetlands and lakes of more than five surface acres. They have had control of Lake Wawasee and have already taken action there against dredge and fill operations in the marshland last year. New Powers The new power of the corps include requiring a permit from every contractor, farmer and landowner who affects the environment in even the smallest way by discharging dredged or fill material into the waters of the nation. By all waters, this means every little stream, creek, pond, swamp, river ahd lake in the United States. Before any fill can be put on the banks of a stream, before land is cleared and construction done near a stream which might affect its fill content or before any bank erosion stabilization is done, a permit has to be granted. The corps was given its new powers under Section 404 of the Federal Clean Water Act. However, in a press release out it says the corps will probably not be too hard about the permits, especially since President Carter has put a freeze on the hiring of any new employees to process dnd enforce the permit requirements. After-the-fact Enforcement The press release also says due to the enormity of policing all waters in the nation, the corp’s permit powers will be “more of an after-the-fact approach.” The corps “will exercise restraint and reasonableness" and “will determine whether it is in the public interest to stop work or allow it to continue while the permit application is processed.” The press release also explains
that the corps district engineer will be required to make public notice of’ his decision. The corps hope to rely on local environmental groups to help with the permit enforcement. When violations are seen, the corps will then step in and take action. 13 receive degrees from Ball State MUNCIE — Thirteen Kosciusko County students completed work for degrees during the spnng quarter at Ball State University.
