Student files suit against Wawasee

Last Wednesday, Stephen J. Cromer, a Wawasee High School junior, filed suit in US District Court, Fort Wayne, against the Lakeland Community School Corpaation. In the suit, Cromer asks that the school’s athletic code be declared unconstitutional and the school be prohibited from barring him from participating in sports. The suit states he was not charged with consumption of the beverage and has not admitted to drinking at that time. Cromer and his parents, Mr. and Mrs. James A. in track, had finished the football season befae he was arrested in December 1976, when he admitted to consuming one-half can of beer. School officials considered the second arrest as a second violation of the school’s policy. As a result, Cromer was suspended from participation in Wawasee spats. The student, his parents and attorneys met with the high school administration, the athletic review board, Superintendent Don Arnold and board of school trustees and School Attorney Robert Reed. “Each group has upheld the rules of the high school,” Arnold said. The athletic rule has been challenged in the past. “It has been questioned at times, but it has never been in court,” Arnold said. Other students have lost their athletic eligibility for violation of the rule. “And, they have taken their punishment and accepted it,” Arnold said. The attorneys fa Cromer state the second arrest was the first drinking offense and that suspension from sports for consuming one-half can of beer constitutes cruel and unusual punishment. The suit requests Cromer be reinstated in athletics, the corporation be prohibited from enfacing the rule and attorney’s fees.
