Area plan accepts township jurisdiction
During the monthly meeting of the Kosciusko County Area Plan Commission last Wednesday night, the quorum present agreed to accept jurisdiction over Turkey Creek Township and okayed the resignation of the body's director. Commission director Robert Orcutt, said the matter was on the agenda, but there was not enough advanced notice to make the issue public The mailed agenda received by the commission members stated no appeals were slated for hearings at the meeting. But an application to the commission from Don Byrd. Syracuse, for the plotting of a subdivision on Lake Wawasee. pronipted the discussion and resulting agreement Byrd said he has been quiet for three years, spent his own funds and been advised by eight attorneys to bring his subdivision plotting to the county commission. County attorney and commission attorney Richard Sands advised the to include Turkey \Creek Township in its jurisdiction. Orcutt said “Hopefully.’ Ojcutt commented, “this way. if there is any opposition. their recourse is to file against the area plan commission or against the private individual, “for non-compliance 7lf it’s going to take litigation to get it over with, then let’s get it settled.” Orcutt added. Members of the Syracuse Plan Commission were not notified of the issue to be discussed at the meeting The reason for this was. question determined in the courts. "But it appears that the courts are never going to take any action without prodding and pushing," Orcutt concluded. Commission members Victor Virgil, Charles Brouwer, Bob Bruce and Creighton decided to have the commission assume jurisdiction of the township. Jack Lawson, attorney for the Syracuse Plan Commission, said the matter is still somewhat confused, with cases filed by Mrs. Joe W. Baker and Jack Mason still to be heard in courts. But Lawson said he will advise the Syracuse Plan Commission to request the town board and its legal counsel to move their cases along to have the jurisdictional question settled in court. "It would be in the best interest of the public and those involved to determine the matter legally s ” Lawson commented Such decisions could be appealed in an appelate court after judgement has been reached in the cases, Lawson explained And both planning bodies may be advised to request the attorney general for an opinion on the several state statutes being used in the litigation over the jurisdiction. Law-son added. A public meeting of the town board and Syracuse Plan Commission is set for 7 pm Thursday night in the town hall Lawson will explain the Bums
