Section 203 Billing tor sewage charges shall be made monthly An estimated billing will be made in each of me first two months of me quarter A final adjusted bill will be rendered based upon water meter readings in the third month of each quarter Section 204 In me event two (2) or more dwelling units such as mobile homes, apartments or housekeeping rooms discharging sanitary sewage, water or other liquids into the Town's sanitary sewer system, either directly or indirectly, are users of water and me quantity of water is measured by a single water meter, then in such case billing shall be for a single service in me manner set out elsewhere herein, except mat the minimum bill shall not be less man the number of such dwelling units times MOO per quarter In me case of mobile home courts, me number of dwelling units shall be computed and in terpreted as the total number of mobile homes located and installed in said court plus any other dwelling units served through me meter. A dwelling unit shall be interpreted as a room or rooms or any other space or spaces in which cooking facilities are provided. Section 205 Except for billings to multiple users such as apartment houses, mobile home courts and housekeeping rooms, me rates and charges may be billed to the tenant or tenants occupying me properties served unless otherwise requested in writing by me owners but such billings shall in no way relieve me owner from liability in the event payment is not made as herein required The owners of the properties served which are occupied by tenants shall have me right to examine me collection records of me Town for me purpose of determining whether such rates and charges have been paid by such tenants, provided that such examinations shall be made at me office at which said records are kept and during the hours that such office is open for business Section 2M Charges shall be prepared and billed by me Town of Milford and shall be collected in me manner provided by law and ordinance. Meter Site Quarterly Minimum Charge $ 4.00 1" ‘ 9.00 1 to'' 18.00 1 to" 24.00 r' 39.00 3" . 135.00 4" 240.00 4" 340.00 Section 2M in me event a lot, parcel of real estate or building discharging sanitary sewage, industrial wastes, water or other liquids into me Town's sanitary sewage system, either directly or indirectly, uses water in excess of 60,000 gallons per juarter, and it can be shown, to me satisfaction of the Town of Milford, that a portion of the water measured by the water meter or meters does not and cannot enter me sanitary sewerage system, then me owner or other user, at the user's expense, shall install and maintain a meter or meters acceptable to the Town in such a manner as to determine the quantity of water actually entering the sewerage system, and me customer shall be billed only for mat measured quantity of water entering the sanitary sewerage system so determined. Section JOf In me event a lot, parcel of real estate or building discharging sanitary sewage, industrial wastes, water or other liquids into the Town's sanitary sewerage system, either directly or indirectly and uses water from a non municipal source which is not measured by a water meter or is measured by a meter not acceptable to the Town then the owner or other interested party, at his expense, shall, at the Town's request, install and maintain meters, weirs, volumetric measuring devices or any adequate and approved method of measurement acceptable to the Town. Section tie Domestic users who do not have a metered municipal supply of water shall be charged a flat price of $4.00 per month per family dwelling unit. ARTICLE 111 ADJUSTMENTS TO RATES ANDCHARGES Sectton Ml In order mat the domestic and residential users of sewage' service shall not be penalized for sprinkling lawns during the months of June, July and August, ma billing for sewage service for residences and domestic users for said summer months shall be based upon the water usage for the previous months of December, January and February, in me event the water usage for said previous winter months is greater than the water usage for said summer months, men the billing for sewage services shall be computed on the actual water used in the months for which the sewage service bill Is being rendered Domestic and residential sewage service as applicabie to the sprinkling rate shall apply to each lot. parcel of real estate or building which is occupied and used as a residence Said sprinkling rate shall not apply to any premises which are partially or wholly used -for commercial or industrial purposes. In me event a portion of such premises shell be used for commerciei or inmntrial purposes. the owner shall have the privilege of seperating the weter service so that the residential portion of the premises is served through a separate meter end in such case the water usage is registered by me water meter serving such portion of the premises used for residential purposes would qualify under the sprinkling rate. To determine the strength of the sewage and wMtes. samplings and analysis shall be made from time to time whenever it is deemed desirable by me Town of Milford. After charges have been established based upon me strength of sewage and wastes, the owner may request reconsideration of these charges by me Town by submitting analyses of composite samples of the sewage and wastes subject to such charges, certified by a Registered Engineer or a qualified graduate chemist. The Town may then adjust me charges to me ordinance rates required by such analysis or may recheck me findings by additional samplings and analysis. Requests for rate adjustments by the owner may be submitted no more often man once every twelve (12) months. The determination of Suspended Solids and Five day Biochemical Oxygen Demand contained tn me waste shall be in accordance with the latest copy of "Standard Mameds for me Examination of Wafer. Sewage and industrial Wastes", as written by me American Public Health Association, me American water works Association and the Water Pollution Control Federation Section 301 In order mat me rates and charges for sewage services may remain fair and equitable and be in proportion to me cost of providing services to the various users or user classes, the Town shall cause a study to be made wimm a reasonable period of time following the first full calendar year of operation, subsequent to the completion of me improvement project Such study shall include, but not be limited, to an analysis of

me costs associated with the treatment of excessive strength effluents received from industrial users as defined by The En vironmental Protection Agency the volume and delivery flow at tributable to me various user classes, the financial position of the sewage works and me adequacy of its revenue to provide reasonable funds for cash operation and maintenance expenses, debt service requirements and capital improvements, including replacements, to the waste treatment system Thereafter, on an annual basis, wimm a reasonable perioc- of time following each calendar year, toe Town shall cause a similar study to be made tor me purpose of reviewing the fairness and equity of the rates and charges for sewage services on a continuing basis. Provided, however, mat mis section shall not be applied for any year in which the Town does not receive sewage from industry and me study is not required by The Environmental Protection Agency. ARTICLE IV VALIDITY Section 401 The invalidity of any section, clause, sentence, or provision of mis ordinance shall not affect me validity of any part of mis ordinance which can be given effect without such invalid pan or parts. ARTICLE V ORDINANCE IN FORCE Section Ml The rates and charges fixed by this Or. dinance shall ijjcome effective for services rendered in me first full water billing quarter after f nal adoption of mis or dinance. The Board of Trustees of the Town of Milford Junction may take any appropriate action, upon said ordinance after me public hearing and upon final adoption of said or dinance the same shall become effective in accordance with me provisions contained in said ordinance.
