Mobile Home Park TM term "mobile Mme cork" means an area of land upon which two or more mobile Mmes are harbored either f *ee of charge or tor revenue purposes, and snail include any structure, building, tent, vehicle, or en closure used or intended tor use as a part of tM facilities of such mobilt home park Mobile Home Stand That part of an individual tot which has Been reserved for the -pl« cement of tM mobile Mme. appurtenant structures or additions Permit The term "permit" means a written authoriia’ion issued by me Ordinance Ad ministrator permitting tM owner to con struct or alter a mobile Mme park under mis Ordinance and me regulations promulgated thereunder Person This term means an individual, firm, partnership, corporation company, or association Service Building This means a building rvanager's office, laundry facilities, maintenance equipment, toilet facilities for employees, and emergency sinitary facilities ARTICLE 1 — Minimum Regulations Each park to oe constructed under the provisions of mis Ordinance shall adhere to me minimum regulations as are required by me Indiana Mobile Home Purks Act. and the State Board of Health regulating mobile Mme parks, and to me terms and provisions of mis Ordinance ARTICLE 3 — Permit to Construct No person, firm, or corporation shall construct or alter a mobile home park witMut first obtaining a permit therefore Each permit to construct ard each permit to make alterations therein shall be prominently displayed in IM office of me mobile Mme park for wh ch tM same is issued or on me premises in a prominent location ARTICLE 4 — Application for Permit In order to obtain a permit to construct a new mobile Mme park, or an alteration to an existing mobile Mme park, me applicant shall file with me Ordinance Administrator a written application seating forth the following 4 1 The full name and a<*3ress of me owner or owners thereof 4 1 TM location and legal description of me tract of land certified on a plat of a survey made by an Indiana Registered Land Surveyor and drawn to a scale of not less man 1 inch = 100 feet 4 3 The plat plans of me park drawn on a scale of not less than 1 inch =IOO feet, plans and specifications for new buildings and facilities or me proposed alterations in existing facilities Plans shall show proposed facilities for water supply garbage, sewage or waste disposal, community facilities. Streets, parks, playgrounds or recreational areas, all in compliance wim mis Ordinance and in compliance wim me Indiana Mobile Home Parks Act It deemed necessary. tM Plan Commission may request information qp existing park facilities if they affect me proposed park addition or alteration TM plat plans shall contain, among other things, me following (a) The date on which such plat plan was prepared (b) An arrow indicating North (c) All mobile Mme lots shall M properly numbered on tM plat plan 4.4 Said application shall have appended thereto plans and specifications making provision for, among others (a) Discharge of waste, sewage, es fluents, and storm water run-off. (b) Elevationsof highs and lows to show me general topography of me proposed mobile home park, said elevations shall be based on Mean Sea Level Datum as established by me U.S Coast & Geodetic Survey, and ' (c) Grades of streets and any ditches in said proposed mobile Mme park. 4.5 A statement of fire fighting facilities, public or (rivate. which are available to tM proposed mobile home park 4.6 An affidavit of me applicant as to me truth of the matters contained in me application shall be attached thereto Each application for a permit to construct shall be accompanied by an application fee in tM amount of ten (10) dollars plus twenty five (.25) cents tor each mobile Mme space in the proposed park wim a minimum charge of fifteen (IS) dollars to cover tM cost of checking and verifying me proposed park plat Each application fee shall be paid by certified check or money order made payable to the Kosciusko County Treasurer and shall be delivered to same tor deposit in me County General Fund. ARTICLE 5 — issuing of Permits 5 1 Upon approval of said application by the Kosciusko County Area Plan Com mission, and approval by the Indiana State Board of Health, me Ordinance Ad ministrator shall issue a permit to construct or alter me proposed mobile home park 5.1 If a permit to construct a mobile Mme park is issued, me applicant shall upon completion thereof, Mtity me Ordinance Administrator The Ordinance Ad ministrator shall men inspect the park and if completed in accordance wim tM accepted application, tM Ordinance Administrator shall issue a Certificate of Occupancy No mobile Mme units shall be placed in the park until such time as a Certificate of Occupancy has been issued. In the event the entire project is Mt completed at me time of me request tor a Certificate of Occupancy is made, me Ordinance Administrator may issue a Certificate of Occupancy for com pleted blocks of mobile home lots consisting of Mt less man five (5) mobile home lots or ten (10) percent of me total lots proposed, whichever is greater Additional Certificates of Occupancy will be issued only tor blocks contiguous to me original block Refusal of me Ordinance Administrator to issue a Certificate of Occupancy shall be accompanied by a written statement specifying me objections to tM issuance thereof 5 3 No change in any sanitary faculties, methods of water supply, sewers, drainage, garbage or waste disposal, and m change in me plat plan shall be made without first making a written application to tM Or dinwice Administrator and receiving a permit theretor Such application shall be made in me way and manner hereinbefore set form No application fee shall be required to accompany an application tor a permit to alter a park where such alteration involves only a reduction in tM number of mobile Mme spaces to a number less man such park it currently permitting Such change or changes shall comply with such safety and sanitary code, building code, rules and regulations as are applicable thereto 5 4 A permit to construct does not relieve me applicant trom securing any other permit or from complying wim any other ordinances of Kosciusko County. Indiana, or applicable laws of me State of Indiana ARTICLE 6— Environmental — Open Space — Access Requirements 6 1 TM tract of land proposed tor a mobile Mme park. H less man five (5) acres shall be subject to tM approval of tM Kosciusko County Board of Zoning Appeals 6 1 Soil ano Ground Requirements (a) Exposed ground surtaces in all parts of every park shall be paved or covered with stone screenings or other solid material or protected with vegetation that is capable of preventing soil erosion and tM emanation of dust during dry weather (b) Where me topography has a stope of twenty five (25 per cent) percent or more, a rip wall, cribbing, orbther approved system of soil and stope stabilization shall be installed and maintained a 3 Physical Hazards m Parks (a) Adequate protoctive barriers snail be provided and maintained where there is a stope m excess of 45 degrees and a change in elevation of six (*> toot Such barriers may include, but are Mt limited to. continuous shrubs or fences (b) Swimming pools shall be screened or fenced or secured when not in active use to prevent injury Fencing or other artificial enclosure shall completely enclose Hie pool . (c) Sw-mm.ng POOH shall be con structed and maintained m accordance wim me requirements of tM State Board of Heaim 6.4 Non residential uses (a) No part of any park shall be used for Mn residential purposes except such uses as Kt required for direct servicing and well being of park residents and tor the management and maintenance of me park, provided that coin-operated machines for Hie exclusive use of park residents shall be permitted and deemed not to be in.violation of Hie restrictions of this Ordinance Nothing contained m this Section shall be deemed to prohibit casual sales of an existing privately owned mobile Mme situate on a stand and connected to pertinent utilities within an established park AS Required Separation Between Mobile (a) Mobile homes shall be separated 'from each otMr and from other buildings and structures by a distance of at least twenty (20) feet Every mobile Mme »t shall contain a minimum of five thousand

(5000) square feet, and have a minimum lot width of fifty (50) feet (b) An accessory structure which has a horizontal area exceeding twenty five (25) square feet, attached to a mobile home, has an opaque to or roof that is higher than adjacent window sills of such mobile home, shall for purposes of this separation requirement be considered to be part of the mobile Mme Roofed over patios, carports, and individual storage facilities shall be included as part ot me mobile home in determining separation between mobile Mmes 6.6 Required Setbacks, Buffer Strips, and Screening in Mobile Home Parks (a) All mobile Mmes, if fronting upon a public road or street, and access to said mobile Mme lot is direct from said public road or street, shall be located at least fifty (50) feet from the right of way line of said public road or street, and at least ten (10) feet trom any other park boundary No in dividual mobile home, including any ac cessorv structures, shall be placed less man fifteen (15) teet from me right of way ot any park street, common parking area, or any other common area accessible to park residents (b) All mobile Mme parks may be required to provide a buffer strip at least five (5) feet wide along all or part of the property lines Where effective visual barriers do not already exist along such property line, me buffer strip may be fur nished wim screening at least six (6) fee* high and consisting of fences, free standing walls or natural growth Such growth shall consist of a compact growth of shrubbery, hedges, evergreen, or other suitable planting to serve as an effective visual screen Fences or walls shall not contain electrical charges, barbed wire, broken glass, or other material designed to do bodily harm 6.7 Required Recreation Areas in Mobile Home Parks (a) In all parks accommodating or designed to accommodate ten (10) or more mobile homes, there shall be one or more recreation areas which shall be easily ac cessible to all park residents The size of such recreation areas shall be based upon a minimum of 250 square feet tor each space that is designed to accommodate a mobile Mme. A minimum of one half (' 5) acre shall be set aside for recreation area. Recreation areas shall be so located as to be free of traffic hazards and should, where topography permits, be centrally located 6.8 Street Construction and Design Standards (a) Street Widths All multi lane streets having on street parking shall have a minimum width of thirty two (32) feet All multi lane streets with no parking permitted shall have a minimum width of twenty five (25) feet One way streets with no parking shall have a minimum width of fifteen (15) feet. (b) Pavement Design All entrance roads which exceed twenty five (25) feet in width shall have the standard County cross section All streets must be hard surfaced regardless of width (c) Intersections Within one hundred (100) feet of an intersection, streets shall be at ap proximately right angles A distance of at least one hundred fifty (150) feet shall be maintained between centerlines of off set intersecting streets. Intersections of two or more streets at one point shall be avoided <d) Grades Grades of all streets shall be sufficient to insure adequate surface drainage, but shall Mt be more than eight (8 per cent) per cent Short runs with a maximum grade of twelve (12 per cent) per cent may be per miffed, provided traffic safety is assured by appropriate paving, adequate leveling areas and avoidance of lateral curves (e) Temporary Street Approval The Ordinance Administrator may upon written request from the developer, permit a temporary gravel street, covered with an approved dust sealer for a period of six (6) months from the date of the waiver, (an additional six (6) months extension may be granted if deemed necessary by the Plan Commission) at which time the developer, owner, or lessee shall have installed the required hard surfaced streets. In the event the developer, owner, or lessee tails to install the streets as required, he will be subject to the penalty provisions of this Ordinance or any other Ordinance or law dealing with occupancy or use of real estate by any per son, firm, corporation, or association (f) All streets within the limits of a mobile Mme park shall remain as private streets, and the responsibility for the maintenance of said streets shall remain with the owner or owners of said mobile Mme park 6.9 Parking Requirements (a) At least two (2) parking spaces shall be provided for each mobile home lot. Parking bays shall be so located as to provide convenient access to mobile home spaces On street parking may be utilized in meeting this requirement. (b) The following minimum standards for parking spaces shall be used The minimum size per parking space is nine (9) feet wide by twenty (20) feet in length. The following standards will apply to angle parking Minimum Parking Curb Minimum Backing Angle Length Bay Depth Depth Jfr 90 degrees 9" 18' 26 60 degrees 12 5' 17' 20' 45 degrees 12 7' 16' 19' * Measured perpendicular to the curb 6 10 Pedestrian Access (a) All parks shall provide sate, con venient pedestrian access between in dividual mobile Mmes, the park street system, and all community facilities provided for park residents and all required open areas, by adequate pedestrian ways 6 11 Required Illumination of Park Street System (a) All parks shall be furnished with sufficient electrical systems and lighting units at the owner's expense, so spaced and equipped with luminaires placed at such mounting heights as will provide adequate levels of illumination for the sate movement of pedestrians and vehicles during the hours of darkness 6.12 Existing Mobile Home Parks (a) Any mobile home park which existed upon the effective date of this Or dinwice shall be regarded as a conforming use and may be continued, except that any change in layout, expansion dr extension shall be subject to all provisions ot the Kosciusko County Mobile Home Park Or dtnance. State Board of Health, and the Kosciusko County Board of Health regulations ARTICLE 7— Water Supply 7.1 General Requirement (a) Every park shall have a water supply capable of providing a sufficient supply of potable water under adequate pressure to water supply facilities for mobile homes, service buildings, drinking fountains and other accessory facilities, as required tor me well being of park residents and for park maintenance Such systems shall be designed, constructed, and maintained in accordance with the State Standards of the Indiana State Board of Heaim and me Kosciusko County Board of Heaim ARTICLE 8 — Sewage Disposal 8.1 Sewage System and Connections (a) All sewage and other water carried wastes shall be disposed of into an adequate sewage system. All sewage systems shall be constructed in conformity wim all me laws of me state of Indiana, regulations of any Department. Division, or Board of me State of Indiana, and any Ordinance of Kosciusko County. Indiana relative thereto (b) Each mobile Mme site snail be provided wim a sewer connection tor me combined liquid waste outlet or outlets of each mobile Mme It shall be the duty of me owner or operator of said mobile Mme park to provide an approved type ot water tight and odor tight connection, and it shall be me duty of said owner or operator to make such connection and keep all occupied mobile homes connected to said sewer system while located in a mobile Mme park Sewer connections in unoccupied mobile home sites shall be so closed mat mey will emit no odors or cause a breeding place for flies No water or waste shall be allowed to fan on me ground from a mobile home ARTICLE 9 — Electrical Distribution System 9 1 General Requirements Every park shall contain an electrical wiring system consisting of approved wiring, fixtures, equipment, and ap Purtenances which shall be installed and maintained m accordance wim me ap piicabie codes and regulations governing such systems AU parts of me park Elec trical Distribution System Shall conform wim approved standards for safety to life and property and wim accepted engineering practices Electrical wires may be un derground ARTICLE 10 — Fuel Supply and Storage 10.1 Natuaral Gas Systems Natural gqs piping systems in an parks shall be installed and maintained in con tormity wim accepted engineering practices and me rules and regulations of the authority having jurisdiction 10 2 Fuel Oil Systems All fuel oil systems provided for mobile homes, service buildings, and other struc hires shall be installed and maintained in conformity wim me rules and regulations of me authority having jurisdiction Fuel oil systems underground shall be located at a

pipe ARTICLE 11 — Alterations Additions Occupancy _— 11 1 General Requirements C All building, plumbing, hearing, air conditioning, and electrical alterations and repairs in mobile Mme parks and individual mobile Mmes, shall be made in accordance with applicable State and Local regulations 11 2 Permanent Additions No permanent additions involving footings, foundations, or other structural changes in or to a mobile home, or mobile Mme stand shall be built onto or become a part of any mobile Mme or mobile Mme stand without first securing a building permit therefore Nothing contained in this Section shall prohibit the installation of awnings or temporary seasonal structures Mt requiring permanent structural modification of a mobile home or mobile Mme stand 11 3 Occupancy of Mobile Homes Occupancy of the mobile home shall be limited to the design capacity of the mobile Mme ARTICLE 12 — Temporary Use 12.1 Nothing in this Ordinance shall be construed to include the State Parks of Indiana The term "Mobile Home Park" shall Mt be construed to include buildings, tents, or other structures maintained by in dividuals or a company on their premises and used exclusively to temporarily Muse their own farm labor Neither should it include any military establishment of the United States or of State; nor any park or State or County Fairgrounds for a period during, immediately prior to and im mediately subsequent to the holding of the fair, not to exceed two (2) weeks in all., Neither should it include the area or* premises on any fariti upon which is har bored mobile Mmes occupied by persons employed upon such farms tor Mt more than ninety (90) days in any calendar year in the production, harvesting, or processing of agricultural or horticultural products produced on such farm. Sanitary facilities for any and all of the above type installations shall be subject to the approval of the Kosciusko County Board of Health. ARTICLE 13 — Inspection 13.1 The Ordinance Administrator shall enforce the provisions of this Ordinance and shall inspect, at least once a year, each mobile home park and all of the ac commodations and facilities therewith. The Ordinance Administrator is hereby granted the power and authority to enter upon the premises of such mobile home park at any reasonable time for the purposes herein set forth. He is further empowered to certify to the State Board of Health or any other licensing agency, the fact that a park is being constructed, or that an opeator is in violation of this Ordinance ARTICLE 14 — Hearing 14 1 Any person refused a permit to construct or alter a mobile home park shall have the right to a hearing before the Kosciusko County Board of Zoning Appeals, which shall have full power to conduct such hearings, issue supoenas. administer oath and affirmations, and all other powers necessary to such hearings (a) AU hearings before the Board ot Zoning Appeals shall be open to the public (b) The Board of Zoning Ajbpeals shall keep minutes of the proceedings, showing its determination and shall also keep records of its other official actions (c) In the performance ot its duties under the provisions of this Ordinance, the Board of Zoning Appeals may incur such expenditures as shall be authorized by the County of Kosciusko (d) The Board of Zoning Appeals shall adopt its own rules of procedure not in conflict with this Ordinance ARTICLE 15 — Penalties 15.1 Any person who violates any provision of this Ordinance, or any provision of any regulation adopted by the Ordinance Administrator pursuant to authority granted by This Ordinance, shall upon conviction, be punished by a fine of Mt less than twenty (20) dollars nor‘ more than three hundred (300) dollars for each offense Each days failure of compliance (with any such provision shall constitute a separate violation ARTICLE 16 16.1 All Ordinances or parts of Ordinances in conflict herewith are. to the extent of such conflict, hereby repealed. Kosciusko county receives $ 61,610.37 in PTR funds

The property tax replacement fund board met in Indianapolis last week and authorized early distribution of $35.9 million to the 92 counties from the property tax replacement fund. The early authorization represents 30 per cent of the property tax replacement funds to be distributed to the counties by May 1. The first distribution, representing 15 per cent of the spring estimated distribution, was sent to the county treasurers last Friday. The second 15 per To attend March seminar in Washington The United States Department of State has selected Father Francis Kelly Scheets, OSC, a teacher at Wawasee Prep, to attend the scholar-diplomat seminar, held in Washington, D.C. the week of March 4. The state department conducts a series of seminars each year to enable scholars, business and professional leaders to get an open look at the practical aspects of the development and conduct of foreign policy. Father Scheets has been selected to attend a week-long session in international economics and business affairs. Hie group will vary in size from 10-20 participants and each member is assigned a host officer. Father Scheets will be able to observe the work of his host, have access to the files in that office, and attend staff meetings. Currently Father Scheets teaches economics and government at Wawasee Prep. During the summer of 1973 he delivered a major speech to the general chapter of the Crosier Order on international economics and social justice. While he has long had an interest in this area of international problems, his main concern is with Catholic church management. He is the author of several books regarding parish management information systems; and has developed four computerized methods for studying parish finances. Also, he is the director of the office of fiscal planning for the diocese of Fort Wayne-South Bend. In 1971 Scheets received a Ph D, from Ball State university in American history, economics and computer science. Until recently he was part-time assistant at Saint Thomas Parish in Elkhart.
