School Suit Finalized After Two Years The appeals court of the 7th U.S. Circuit Court of Appeals in Chicago has declared that Greg Carpenter of Syracuse has the constitutional right “to wear his hair in the mode he chooses” in a hearing last Thursday, upholding the earlier findings last year of U.S. district court judge Robert A. Grant of South Bend in a suit filed by Carpenter against the board of education at Syracuse. The higher court ruled that the youth, a student at Wawasee high school, was unconstitutionally deprived of classroom participation due to the length of his hair violating the school’s dress code, and the appellate court ruling said the school dress code denied Carpenter the due process guarantees of the constitution. Also, “We conclude that the democratic process used in adopting the code (a student vote) does not justify the denial of Greg Carpenter’s constitutional right to wear his hair in the mode he chooses,” signed by judges Roger J. Kiley and Latham Castle. Judge John Paul Stevens dissented with “Society does have a legitimate interest in both the continuity and the mutibility of its mores.” Appeals This was a continuation of a suit originally filed in May of 1970 in district court, South Bend division, by young Carpenter’s father, Chester Carpenter, against the superintendent of Lakeland Community School Corporation, the principal of Wawasee high school and members of the school board, supposedly on validity of the 197071 dress code, and a hearing was held on September 4 of that year wfiereas it was entered in the records as the finding by Judge Grant was in reality adjudged against the student body of the high school, for it was the action of the student council, approved by the majority vote erf the student body, that placed into the hands of the administrators the dress code to be enforced for the school year. The question in the court dealt only with the deviation clause required in the code for the right of a child to wear his hair at any

length without the parents written consent. It was ruled by the judge that the right to wear one’s hair at any length is guaranteed by the Constitution of the United States, and exceptions arise when cleanliness and health become a matter of concern. Laws of the state provide for the suspension of students when a health hazard exists. At this time, a statement was received from the board of school trustees that an appeal of ruling would be made to the 7th Circuit Court of Appeals in Chicago. A second hearing was lost in April of 1971 at South Bend and Greg Carpenter did graduate with the seniors of 1971. He is currently employed with Leisure Time at Nappanee.
