that Carpenter was notified by letter dated April 29 from the principal of the school of his three-day suspension effective that day “for reasons that were not clear' in the letter” but , presumably because he failed to abide by the school Mpearance code in that he didTiot cut or shorten his sidebums or hair. School authorities have noted the expulsion was not only for a violation of the dress code but also for conduct reasons. Parents of the youth also did not exercise their rights by coming before the authorities at any time for discussions or explanations On May 4 Greg attempted to enter the high school following the threeday suspension period to learn he had been suspended from the school program for the remainder of the second semester of the 1969-70 school
year. His suspension was also confirmed by a notice from the school corporation superintendent directed to the plaintiff and his parents, stating it was based on a directive of the school board of trustees as a result of action taken at a meeting of the board on April 30, 1970. The suit follows “the action was taken by the defendants after a letter was sent from the plaintiff's attorney to the defendant, Henry L. Smith, principal of Wawasee high school, with copy to the defendant. Don H. Arnold, informing them of the decision of the United States Court of Appeals for the seventh circuit dated December 3. 1969. entitled Breen v. Kahl, when that Court held invalid a school appearance code promulgated by the Williams Bay. Wisconsin, schools.”
Also “that the defendants assessed penalties against students inducting the plaintiff for absences from school resulting from alleged violation of school rules and regulations.” And “that if the plaintiff, Greg Carpenter, is not directly readmitted to school. there will be a delay in his completion of his present school year of high school, and his chance of ever receiving a high school diploma from Wawasee high school will be substantially diminished, and as a result he will suffer immediate and irreparable psychological and financial damage and harm.” The plaintiff asks the court to issue its order to (1) Temporarily restrain the defendants, their agents, employee and all persons in active concert or participation with them or any of them, from denying admission and enrollment of the plaintiff for the 1969-70 school year; or from suspending, excluding or threatening to suspend or exclude him from classes because of the length of his hair or sidebums, or because of his refusal to cut his hair or sidebums At one point in the suit the plaintiffs contend the only reason ever given by any of,the defendants for the plaintiff's expulsion from school and their reason for refusing him readmission was that the length of his hair or sidebums violates rules and regulations of the high schoolNumber two ask by the plaintiff is for a prompt hearing wherein the defendants shall show cause why they and those involved should not be enjoined during the pendency of the action from continuing their denial of readmission to the plaintiff. It continues in asking the consolidating of the hearing with a trial for permanent injunction relief and following the trial, permanently enjoing the defendants and those in concert with them from the continued denial of young Carpenter’s readmission, further suspensions or threats thereof. Also that academic credits taken from him for alleged violations of the appearance code and unrelated to academic perfonhance be restored to him . “Issue its declaratory judgment finding that the defendants have acted illegally and unconstitutionally in suspending the plaintiff from school and have acted illegally, unconstitutionally in a capricious and willful manner in refusing to permit the plaintiff readmission to school.. “That the plaintiff recover damages in the amount of two thousand dollars as a result of his
suspension from the present school year and that he may recover his costs from the defendants, and such other relief as may be just and proper in the circumstances.” Thomas H. Singer of South Bend was signing attorney for the suit of counsel with Craig Eldon Pinkus, executive director of the Indiana Civil Liberties Union. Indianapolis. Herbert Morehouse led the evening adult Bible class. The Sons of Praise quartet sang several request numbers before David Lewycke gave the evening's message. David and Loetta Morehouse gave some accounts of their recent trip to Haiti.
