Bogard swore that the complaining witness said in a conversation with him before the sale of beer ok place: "I am 21. and I'm going to vote for Cleveland just as bard." Bogard told the court he thought young Wildy was of age. At-] torney Foley contended that aconvictioa could not be made for two reasons: (t) ihe state had tailed tosao^ what kind ot beer itfcw«s (2) Bogard believed the witness was of age from his own statement. The court Baid: "I think there has been sufficient evidence as to the beer. As to sge ot the witness I think the question as to the defendant's knowledge of it is in doubt. At the top of his voioe he was just about to te.l a story of some kind about a colored man, and he let slip the word "nigger." There were three colored men on the jury. THE CASE AGAINST SAMUELS. Wm'. Samuels ia on trial to-day before a jury for entering the office of the nail works compauy on the night of Nov6mber 21et with burglarious ^intent. Judge Mack is a stockholder cf ihe company aud transferred the case lor that reason to Judge Scott. Samuels.' counsel welt on the lact that he was a poor man with a tamily, and the defeusc was that Samuel* was passing the office of the company, Saw alight and finding tbe door opeu went in, thinking the watchman was thi re. He was met by Night Watchman Hannah, whom he knew, as he was coining out, and.be was placed under arrest. Counsel said it was not the case of the State against Simuels, but It was a case of the nail works company, a corporation, supported by a watchman Who wanted an opportunity to show be had been dutiful, against an ineocsnt man.
Night Watchman Hannah, who said he hact been employed in that capacity for four years, testified that at 2 o'clock in the morning he heard.some o*e fumbling around desk drawers of the office and he went in and found the defendant ther. Witness asked the defendant what he was doing there, and he replied that he was ou:. walking, saw alight and just stepped in. The witness arrested him and turned him over to the police. Other testimony was introduced. Samuels is a puddler, and is about 85. This afternoon the defence introduced many puddlers of the lower rolling mill, who testified to the defendant^ good character. •,

Hybarger wao one of the men who ordered his telephone out during the anti-rate agita'-ii la^t January bathe was compelled to use it again. The deltnse to the present action is that the company failed to keep its contract, inasmuch as it refused 10 ^ive Hy barker's number to persons who called for it, stating that Hybarger was cither disconnected or had no telephone, thereby doing Hybarger $1C0 damages.
