INDIAKAFOLIS, March 3.—At noon today Governor Porter ended the long agony over the appointment of a judge for the new Vigo Circuit Court by issuing a commission to Harvey D. Scott The pressure brought to bear upon him by the friends of the defeated candidates has been something enormoufe and he would have saved himself interviews from hundreds of persons and bushe!s of correspondence and miles of petitions if he could have made up his mind two or three weeks ago. The commission will be sent over at once and will reach Terra Haute by the time the GACBTTB is out. [This ends the long controversy over the appointment of a judge. In the contest all the other candidates have had warm friends who have urged their claims and the delay of the Governor in making the appointment is doubtless due to the fact that he has really been undecided as to whom he uhould appoint. Judge Scotl needs no introduction to the peoyle of Terre Haute and Vigo county. He was appointed once before by Governs or Porter tj fill out the unexpired term of Judge Patterson, deceased. He was nominated by his party for Judge of the Superior Court, but was deieattd by Judge James M. Allen. His term will last until after the general election next year. It does not seem necessary to give a sketch of his caree, which has been frequently printed in the GAZETTE, and is besides well known to all our citizens. The court begins Monday morning. The people look to Judge Scott to preserve the dignity ot the court and to defend the rights of unfortunate witnesses. ED. GAZ]'

Then, again, it a horse enters but finds that he can do nothing and wants to withdraw, but dpes not pay the entrance fee, he is debarred until all such back payments are made good. Encumbrances like this on a horse are like mottgages on property. If the horse is sold his title must be mace clear, not to "mansions in the skies," but to tbe records of the Trotting Association. When our local association closed business last spring there was over $100 due us on horsesofmthis sort. Their owners select the races they enter in and skip some towns, but as all the entries for the circuit close on tbe same day the whole thing is done at once. They have no chance to experiment and then draw out. That is, they can't do it without paying entry fees. The Well Known Prise Fighter Shot Dead in a Chicago Eating House-

His Awailant a Sport named Jerry Dunn, who is Himself Slightly Wonnded

CHICAGO, March 2.—Between 8 and 9 o'clock last night James Elliott, the pugilist aud Jere Dunn, a well-known sporting man and man about town, met in the saloon and restaurant of William Lao gdon, alias Appleton, alias Appetite Bill, ex-bunco and confidence man, and began shooting, with the result that Elliott was killed and Dunn wounded in two places. The trouble dates and back to the time whed Harry Hill and others came here from New York to meet Jem Mace and Slade with a view of arranging a match with John L. Sullivan, whose backer was Jere Dunn.

Harry Hill, when somewhat inelluW, was interviewed, and in the course of the talk reflected severely on Elliott's courage. Elliott began hunting lor llill, who immediately took a train (or New York. Elliott, in an interview, said Dunn had incited Hill to make these remarks in order to cause a quarrel be. tween himselt and Hill, in order that Dunn might have an excuse to shoot him (Elliott). Dunn, in a subsequent interview, let it be known that he would kill Elliott on sight, and as he is a man of unquestionable nerve and determination, no doubt was ielt that a shooting match would occur whenever the two men met.

Last night Elliott and Plaisted, the oarsman, entered "Appetite Bill's" place to get something to eat, aud shortly after Dunn entered. Accounts differ as to the subsequent proceedings. One account says Dunn made a threatening demonstration, whereupon Elliott rose from tbe table, took up a chair and went at Dunn with it, Dunn, in tbe meantime emptying one revolver and drawing another. Dlien's own statement and that of tbe eye-witnesses is to the effect that he was not aware of Elliott's presence till the latter fired, one shot passing under the scalp and across .the top of the head,and another passing through the left forearm. Luther B. Smith, of Denver, Col., and Florence Hull, of Jamesvule, Texas, yesterday purchased a half interest in the cattle ranche of the Cams and Forsythe Brothers, Cattle company, embracing 22, 000 head of cattle and 60,000 acres of land. A sum of $300,000 was paid for it.

Mysterioas Disappearance of Bills ,, From the Files of the State 8enate-

There have not been lacking persons in this community, familiar with the looseness which characterized the official actions of the late prosecutor of the late Vigo Criminal Court, who have believed that this same carelessness, transplanted to Indianapolis, would yield its customary harvest in the State Senate. Now comes the Indianapolis Journal, declaring that the practice of stealing bills from the senate files is becoming too common —as if once was not twice too often It continues its remarks in the following strain, which will create no surprise here: .tM:,

When the so-called "Jennings county" bill was called up for action in the Senate yesterday, it could not be found and has not yet been found. Secretary Kelly says that the shabby desk in which the bills are kept was broken into Thursday night, and in all probability this bill was stolen then^s he cannot account for its absence in any other way. The mysterious disappearance of the bill occasioned much talk in the legislative halls yesterday, and considerable bitter feeling was displayed. It was openly charged that a well-known Democratic senator had 'got away" with the bill, and he was threatened with dire vengeance. A more probable supposition, however, is that it was taken by a lobby who were indirectly iuteresn in defeating it, and who yesterday left the city. It was rumored last night that two other bills were missing from the Senate files, one of which has only local application to this city.
