The Grand Jury yesterday returned two indictments against Wm. C. and Spencer F. Ball, of the GAZETTE. The following is a correct copy of the first of those interesting documents.:

The grand jury of Vigo county in the state of Indiana, good and lawful men duly and legally empanneled, charged and sworn to inquire into felonies and certain misdemeanors in and for said county of Vigo in the r.ame and by the authority of the state of Indiana on their oathes present that William C. Ball and Spencer F. Ball, late of said county on the

aforesaid, did then and there unlawfully and maliciously contriving and intending to villify and defame one Sidney D. Terry "and to bring him into public 6candal and disgrace, and to injure and aggrieve hira, and expose him to public hatred and ridicule, and deprive him of the benefits of public confidence, did then and there print and publish in the Terre Haute Evening Gazette, a newspaper of general circulation, owned, printed, published and circulated by the said William C. Bait and Spencer F. Ball in the city of Terre Haute, Indiana, a certain false, scandalous and malicious and defamatory lible of and concerning him the said Sidney D. Terry, containing among other things the false, malicious, defamatory and libelous words and matters following, that it to sav As for his stool pigeon and office boy, S. D. Terry, The Gazette can have no serious controversy with him. He is worrying himself with what he fancies is fierce invicsive against the Gazette. It does not occur to us s& being worth wH!e to notice the uncorroborated statement of a self-confessed purloiner and reader of other people's letters. A letter theit who has not even sufficient decency and sensibility to understand or appreciate that letter purloining, like eavesdropping, places the person guilty of it outside the pale of respectability, can say nothing to disturb the equanimity of the Gazette to the great injury, scandal and disgrace of the said Sidney D. Terry, and contrary to the form of the statute in such cases made and provided, and against the peace and dignity of the State of Indiana.

in each case. Yesterday afternoon sheriff Hay served the writ on the indicted parties and took their individual recognizances for their appearances on Saturday next.

The above item is taken from the Express of thil morning. Extended comment in this place is unnecessary. When the case comes up in court we will be there, and will take pleasure in showing to the people of Terre Haute the 6limy and tortuous paths through which this creature has crawled at the behest of Patrick Shannon,his owner and master. Though possessed of an alleged newspaper, and [inviting a controversy by abuse extending through two years he runs to the courts, like a whipped whelp with tail between his legs, at the first stroke of the lash. He Is beneath contempt and unworthy the society of decerit people. His paper undeserving the patronage of a business community and is fit only to be handled with a pair of tongs. *5

As for Patrick Shannon, who is backing up this fight as he is also leading his moral, or rather immoral Stewart prosecution which we, welcome eagerly, we started out to edit the salient points of his career and we 9hall keep to our purpose despite these attemps to divert attention. We have enlisted for the war.

THE HORTICULTURAL SOCIETY. The Horticultural Society met at Sugar Grove school house yesterday. There was a good attendance. The dinner was excellent. All the exercises were very interesting.

Questions were asked in regard to why this citv was named Terre Haute.

Mr. H. D. Scott treated the society to an essay on landscape gardening. It was a good thing and called forth some interesting points from Capt. Potter.

Mrs. H. D. Scott read an interesting production. Mr. Buffs essay elicited the closest attention.

Mrs. Aydclotte gave an extempore address of about twenty minutes in iength which was warmly received.

Mrs. J. O. Jones read an^xcellent original poem. Taken altogether the meeting was one of great importance, and will be fondly remembered,
