FOLEY VS. DUENttfEG.

Taking of Deposition*! in the Election Contest.

Before Judge Cirafton F. Cookerly. From Saturday's Dally. The taking of depositions to be uted in the case of James P. Foley vs Hugo Duenweg—the conte6f for the citr treasurership—was proceeded with this morning before. Esquire G. F. Cookerl}^ the officer designated by the circuit court A large crowd of the curious thronged the Justice's*office, within and without the bar, lo the annoyance and discomfort of attorneys and interested partiee.

Judges A. B. Carlton and G. F. McNutt appear for Mr. Foley, the tlcfendent being represented by Judge John T. Scott, Mr. Boudinot and I. N. Pierce, Esq.

Oscar W. Apperson was the first witness called, but he did not answer to his name.

PETER B. VORIS

was then called to the stand and his examination proceeded as follows: ... Question by Judge Carlton.—Were you a student at the Normal rehool the inonth of May last?

Answer.—I was. —Were you the only Peter Voris attending the Normal school during the month of May, 1879?

A.—I do not know. —Where did you board on the day of the municipal election in the month of May last? [Objected to by defendants counsel.]

A.—I boarded at Mrs. French'6, on North Sixth St., between the two railroads, on the east 6ide of the 6treet.

Q.—State whether or not you voted at the municipal election, held in tAc city of Terre Haute, in the early part of May last, which election •was held for mayorj city treasurer, and other offices, and, if so, in what ward did you vote

Objected to by Duenweg's counsel, for the reason that the best evidence in this instance is the poll book, and, for the further reason, that if the witness did vote illegally, the question is one that tends to criminate himself.

Judge Scott said: If this young man were prosecuted for voting illegally, the very nirst thing you would have to prove would be that there •was an election. You can" not prove it by the party himself, neither can you force him to make an admission, either in open court or out of court of any fact, necessary to be made out by the prosecution. It must be proved by evidence aliundi. You propose to go back to the dark ages and erect a tribunal in which to force men to admit facts that might tend to their conviction in the criminal prosecution. Thib young man may testifv if he wants to, but if he stands mute you are at your row's end.

Judge Carlton said that he 6aw no good reason for this burst of judicial indignation and eloquence. It seemed to him that the gentleman had leaped before he had got to the stile. The remark of the gentleman about obtaining evi~ dence to prosecute this young man is entirely superfluous. He well knows that this proceeding is in pustance of a well known statute that has beSin force in this 6tate for a number of "y^Bt and that it is for the purpose of takinyxlepositions de bene esse, or to perpetuate evidence to be used in a suit hereafter to be commenced. I would imagine from the gentleman's eagerness to protect this young man from this court of inquUition, this bloody Assizes, that Judge Scott had been employed to protect him from criminating hijmelf, but the honorable gentleman tells us that he is not his counsel. The witness himself has not objected. If the witness will swear upon his solemn oath that he cannot answer this question without selfcrimination, then we will have a question for discussion. The gentleman says there is better evidence— the poll book. Suppose the poll book does 6how the name of Peter V. Voris? Have we not the right in addition to that to identify the party? The fact that the man'6 name is upon me poll book is not conclusive. %-j,

Judge Scott then spoke. He 6aid: I very well know thib is a proceeding, under a statute that has been in force a number of years to take evidence to be preserved and used in an action hereafter to be begun. But I do not understand, if Your Honor please, that because there is a law of that kind, that therefore you have aright to take illegal evidence—that you have a right to put the thumb screws upon a man and enforce from him that which you could not do if he was in court. I understand it to be the duty, first of the court and also of counsel, to inform this voung man that he need not answer unless he wants to.

Judge C. F. McNutt followed in an able argument. After further legal sparring the court directed the witness to answer the question, which he at first declined to do on the ground of self-crimination He finally admitted that he did vote at the municipal election. The question, "for .whom did you vote raised another objection, and after some argument, the court adjourned until Monday morning.

In a Florida town the other day, some men caught a big rattlesnake, and having made the reptile thsensible by chloroform, they forced down its throat an ounce of prussic acid. Instead of dying the rattlesnake showed fight, and was shot with a pistol.

When a small boy was drowned in Des Moines the other day, the flowery editor sharpened his pencil and began: "At a very early hour Saturday morning occurred one of the most horrible calamities recorded in this city, which palled upon the public like a voice from the grave, so full was it of heroism, loving devotion and horror."

He looked up very humbly, and said he was sorry to be found in such a place, but he could assure the court that he was never in the prisoner's box before. "Never?" asked the court with some severity. "Look a-here, judge," said the culprit, "name the fine, but for heaven's sake don't spring that 'Pinafore' gag on a fellow."—[Turners Fills Reporter.

Professor—"The volume a sphere whose radius is two feet," Preparatory—"I--I don't understand." Professor—"I want you to find the volume of a sphere with a radius of two feet." Preparatory— "Yes, but—how high is the sphere?''

Omar Kingsley, a circus rider, died lately. He formerly performed in skirts, and was known to the public as Ella Zoyara. An effeminate form and manner enabled him to sustain the deception perfectly, and many stories, probably fictitious in ths main, were told of his receiving sentimental overtures from men who saw him ride. Hie marriage to a daughter of Bob Stickney was about the first revelation of his sex.

Two Monroe (Me.) boys who had seen their father kill a hen by chopping her head off thought they would try the experiment in the same direction, substituting a human being for the hen. So a little boy about their own age laid on a plank and one of the others went for a11 axe, which he secured, and was returning to deal the fatal blow when he was discovered, and the axe, which was sharp, taken from him.

It is rumored that the profits of J. H. Haverly for the season of 1S78-9 were $130,000 Mary Anderson,$85,000 A. M. M. It is no new thing, however, for Gambetta to.make himself comfortable, he was renowned in his student days for keeping a better table than any of his comrades. And he has good revolutionary precedent. It is related of Danton that he was one morrting surprised at breakfast by ft sans-cu-lotte, who, glancing at the table, exclaim ed to the revolutionary minister of ju6tice: "What, citizen, dost thou eat partridges?" "Blockhead," replied Danton, "would you rather hpve.,{h$nr by the aristocrats?"

The Rothschilds, of Vienna, have had a magnificent railway carriage built, which is to run between Paris and Vienna for the special convenience of members of the great banking firm in each city.

General Garibaldi going to call the other day on he King of Italy, was dressed in his usual unconventional red shirt—the same costume in which he entered London.
