error, against George A. Ritter, in error to the circuit court of the United States for the southern district of Illinois. The question in this case is whether a city which has bonded itself in order to make a subscription to the capital stock of a railroad can decline to pay the matured coupons of its bonds, on the ground that the latter had been issued without a prev ious submission of the question to the people in a general election. The court holds that the recital on the face of the bond*, and printed on their backs, that the election required by law was duly held, is sufficient, in the hands of an innocent holder, to estop the municipality from offering to show that there really was no such election. The judgment of the lower court is affirmed, with costs and interest. *.•—v--..,.

"Although the service is yet susceptible of improvement in that reRpect, I am pioud to say that so thoroughly have its laws been administered, that in upward of 200,000,000 persons carried on American steamers during the last year, only one person and one-tenth were lost in each million. I do not hesitate to assert that travel by steamer under the existing laws of the United States is safer than in any othercountVy." He devotes a considerable portion of his report to the question of testing boiler iron, and says that it Is evidently necessary that a positive and generally accepted rule be established for deciding this important matter. It is believed that the efforts now being made by this office, supported actively by the manufacturers generally, will introduce into the market, iron of American manufacture for making boilers, equal it not superior, to that made in aiv other part of the world.
