The jury in the Hawkins case came in last night with a verdict which was sealed, and on being opened this morning was found to be "guilty." The court room was crowded, and the announcement created much sensation. Counsel for the people moved the court that defendant bo taken into custody, which motion was stoutly resisted by defendants attorneys. The prosecution, however, were linn in their demand that the case should take the ordinary course, and the U.S. Marshal accordingly was directed to hold Hawkins as a prisoner. Time was allowed to prepare a motion ior anew trial and arrest, of judgment. The penalty of the Utah statute for the crime of adultery is imprisonment not exceeding twenty years, and not less than three years, or by line not exceeding one hundred thousand dollars, or both line and imprisonment, at the discretion of the court. This

test case, and virtually places all polygamies at the mercy of the court, and of the lirat wife, who, under the act is the only party who can institute proceedings against the husband. The case was contested on both sides with great determination, and the charge of Chief Justice McKean to the jury last night is spoken of as being enjinentlv able.

The coal strike at this place which has caused a suspension of work during the present week is now at an end, and it is expected that work in all the mines will be resumed on Monday. A conference of miners and operators was held today, at which the latter conceded the demands of the minerB, who agreed on their part to make no further demands or occasion any further trouble during the season. Owing to this concession it is probable that an immediate advance in the price of coal will take place.

a young man well known along the river, a saloon keeper, was shot by Col. L. D. Watson, of the Watson House, this afternoon. The shot was in return of a grievous insult. Shryock is in a critical condition, and Watson is in custody.

Court

was occupied all day with the Hawkins adultery cas«. Cross-examination of Mrs. Hawkins elicited nothing materially new. She testified that Hawkins gave no reason for taking other women for wives, except that she had had her day, and it was proper he should have 6ome one else. She said she had borne him seven children at the time lie took another wife. The defense offered no testimony, except to prove the marriage of Hawkins with a second and third wife. General Maxwell spoke for the prosecution, and assuming that the defense would rest upon a plural marriage as being part of religious faith, argued that polygamy was in dircct violation of both ecclesiastical and common law. Kitch concluded at a late hour for the defense. He contended that Hawkins being a Mormon, bad no intention of committing crime, and his intention was essential to conviction that there was no law acrainst polygamy when he took a second wife, and iie could not be guilty of adultery, because he was legally married to the woman according to the usages and customs of the Mormon church. I'mted States Attorney Baskin will sum up this evening, alter which the ease will go to the jury.
