My opinion, however, in refsrence to these meas ares, has undergone no change, but-on the contrary has beetr ftrengjheneiby the raulta which have attended their execution i-~

Representatives. If Arb ane&s is not a State in the Union this bill does not admit it- as a State. If, on the other hand, it is a .State in the Union, no legislation is oecessarry to declare it entitled to representation in Con*

This is the plain and simple plan of the Constitution, wid believing that hadit been pursued when Congress assembled in the month of December 1865, the restoration of the Static Would long since' have been completed.
I once again earnestly recommend, that 'It be adopted by iach Hotike in reference to legislation which I respectfully submit, whicn is not only of doubtful constitutionality, therefore unwise anddangerooaM a precedent, but unnecessary not eo effective in its operation ag the tiSode preacribed by the Constitution, ihvolves additional delay, and from its terms should bo taken ritber as applicable to a territory about to be Admitted as one of the
United States, than a State which has occupied place in the Union for upwards of a quarter of a century.
The bill declares Arkansas entitled and admitted to representation in Congress as one of tho States of the Union upon |he following fundamental principles:
That the Constitution of Arkeneas shall never be so amended or changed as to deprive any citizen or class of citizens of the United States of the right to vote, who are entitled to vote by the Constitution herein recognized, except for punishment for crimes that are now felonies at com* mon law whereof they shall have been convicted,: equally applicable to all the inhabitants of said State, provided any alteration of said Constitution prospective in effort be made in regard to time and place of residonce of voters.
I have .been unable to find .in. the Constitution' of the United States any warrant for the exercise of the authority thus 'claimed by Congress, in assuming power to impose fundamental conditions on a State which has been duly.adniitted into theUnion on an equal footing with the original States: in all respects whatever.— Congress" asserts the right to enter a State as it may be a territory and to regulate the highest %'•, prerogative^ aft«e people, the elective franchise. Thi? question is reserved by the Constitution to the States themselves, ann to concede to Congress the power to regolato this subjec, would be to reverse the fundamental principle of the Republic and jplace in the hands of the Federal
Government that which is a creative of the States, the sovereignty which justly belongs to the States, or the people^ the trueeource of all political power by whotfi our Federal system was created, and to whose will it is subordinate.
The bill fails ,to provide in what manner the State of Arkansas is to signify its acceptance of the fundamental condition vm which Congress endeavors to mike unalterable and irreversible, nor does it prescribe ft penalty to be imposed, should the of tha State amend or change the portioned of the Constitution

Section 10 of the schedule provides that no person, disqualified fron votmg or registering under this Constitution shall vote for candTflabri for any oiilce, nor be permitted to Vote for the ratification or rejection of the Constitution at tne polls herein annthor&ed and assumed to be in force before its adoption. In disregard of the law of Congress the Constitution undertakes to impose upon tne electors other and further condition.
The 5th section provides that all persons before registering or voting must take and subscribe to an oath which araotig others contains tho following "That I. accept the civil and political e^ualiw Of all men, and agree to attempt to deprive' any person or persons on account ot race, color or previous condition, of any political or civil right, privilege or immunity enjoined by any other class of men."
It well known that a very large portion erf the electors in all the States, if not All., a majority," do not believe or accept the practical equality of Indians,moogrels or negroes with the race to which they belong. If the voters ih many ot the States of the .North and West were required to take such an oath as a test of tneir qualifications, there is reason, to believe that a majority of them would remain away from the polls rather than comply with such degrading conditions. How far and 19 what extent this test oath prevented the registering of those who wore qualified under the laws of Congress, it Is impossible to know, but such was the effeot, at least sufficient to overcome the small and doubtful majority in favor of the Constitution there can be no reasonable doubt. Should the people of ArkanMus, therefore desiring to regulate the elective franchise so as to makelt conform to the Institutions of a lasgp proportion of the States of the iforth and West, and modify the provision* referred to in the /jfcndamental condition, what is the consequence Is it intended that a denial of representation shall follow? If
