The I other ptrty have generslly contended that under this power Congress could only impose such duties as were necessary to rsise a revenue to carry on the government, and to enable it lo fulfill Its Constitutional engagements. Up to 1846. it msy be said the psrty in favor of high duties lor the purpose of protecting home manufactures, was in the ascendant, and by means of their system of specific duties, that is to say, attvming an article lo cost much more than it did really and placing the duty on that attumed cost, the importation into this country of certain articles manufactured or grown abroad, wss excluded snd the home manufacturer and producer thus got entire possession of our markets to grest injury of the consumer.—
On the first dsy of December, 1840, the preseot system, look effect, establishing a duty or tax of 30 per cent, on the value of the article at the place of exportation, except as I have said on tea and coffee, which are admitted without paying any duty whatever. I think at this day. it will not be denied, that Congress cannot rightfully impose any duty upon any articles imported into our country, except such duty or isx be necessary for revenue purposes-—sll beyond that is injustice. That wss the avowed object of the act of 184G. and 1 have shown, thst under its operation, up to June .30, 1063, six years, and seven months, it has overflowed the Treasury, causing a turplut there which cannot be u»ed% of more than twenty* five millions of dollars! The surplus is caused in part, by the tax of thirty percent. ad valorem, on sugar and molasses, srtioles of prima neccitilt/. ond which the working clauses consume in great quantities. The duties on these article* from Deo. 1846, to the 30th of June. 1062. to which iime alone
I have full returns—being five years and aeven months, amounted to 1.033,418, being on an average of near 94,000,000 annually. It was printed by mistake in the first number thst these duties had amounted, "in the last five years to #6.000,00 It should have read, "in the last year." The following ti»ble will show the quantity of sugsr ami molasses imported from the Jst day of December. 1846, to the 30th day of June 1052, with the lax thereon at 30 per cent, on llicir foreign value.
