The commandant of the Amer ican ship of war threatened with a hostile attack the brig of his Imperial Majesty, the Howard, by pointing her guns against the latter, an announcing in writing that, if an individual detained oo board, and whose nationality was disputed between the agents of the two Governments, was not delivered up to him within a given time, be would come and take him by main force. 2. This act of hostility was committed in the port of a neutral power, friendly to both nations. No doubt a threat to attack a vessel belonging to the navy of a sovereign State, and which carries its flag, is nothing inore or lass than a threat of an act of war. Now the right of making war Is necessarily, and from the nature of that right snhererent in jthe sovereign power: "A right of such great limportance." says Vattel ("Law of Na

IJ. 8. of the 7th September, 1787, (sec. 8) explicitly to the Congress the power of declaring war. In this respect the constitution of the U. S. is in perfect harmony with the European publio law. Ilui this right reserved to the supreme power of each State, would soon become illusory and null if the commsndants of the navaf or other forces were authorized either explicitly or tacitly, to undertake, either from their own will or on the injunction, or with the assent of a diplomatic pr consular agent, acts of hostility and of war against the vessels of troops of another nation, without a special order from the supreme authority of their country, notified in the forms prescribed by the law of nations. It is impossible that the regular govcrmentsof the civilized world would expose their authority as well as the general peace, to the hazards of hostilities commenced without their knowledge, and without the special authorization of tho sovereign power, by any functionary abroad. Modern history offers but few examples of this latter case. One of theso raro instances is the attack on the Dutch East India fleet, which had sought refuge in the port of Ikrghen, in Norway, by the admiral of an enemy's fleet, and although that attack was defeated by the guns of the neutral fort, Vattel, who ia an authority universally recognlftod in matters couneoted with the law of nations, nevertheless accuses that neutral power, (Denmtrk,) of having complained "too mildly ol aft enterprise so injurious to its dignity and to Its righu." in order still bettor to establish the accord of all nations and of all legists of this qtmtion, we may quote the authority of tin American Statesman. fully inviolable by the acts of belligerents 3. That captains of Americaf armed ves sels are not entrusted with the power of making war—that high prerogative being re served to Congres by our Constitution 4. That threatening to sink an Austrian National brig in a neutral port, (or any where else) and preparing to do it, is sot a civil, courteous, and amiable ^proceedure, but virtually an act of hostility.
All these points, we readily concede, are made out, well fortified by unexceptionable authorities, and placed beyond dispute. There can be no need of further argument in their favor. Nay, more: If if be the object of Austria to prove that the sovereignty of Turkey has been grossly outraged in the late proceedings at Smyrna, we consider that position made out to the letter.
The logic is compact, the citations apposite. and the conclusions irresistible. But you .may always distinguish a bad cause from a good one by noting the point of departure of the skilful advocate. He whose cause is just, begins at the beginning but, if bis cause be intrinsically had, he ia sure to begin in the middle. Admit that the whole affair at Smyrna was in gross violation of the sovereign rights of Turkey, and the first question that follows is this:— "Who was the original and responsible

It is, doubtless in the number of those without which a State cannot be govfrned in a salutary manner, and is what is called right of ma jetty." The founders of the republic of the United States of Amer jca, have recognized in the same principle of the Union, the rights reserved to the sovereigpi power. The articles of the confederation and of the perpetual union between ihe States of New Hampshire, Massachusetts, Ate., the ninth of July, 1788, contain the following stipulation, (art. x, sec. "The Congress of the United States shall have alone and exclusively the right to declare war and make peace." that an American National vessel came ao near sinking an Austrian brig in the middle of a Turkish harbor, where a conflict must have ensured the destruction of thousands of neutral property and hudreda of innocent Itves?'"
On this vital point of inquiry Austria is silent. She speaks, indeed, of "a certain individual, detained on board, whose nation* ality wat contested by the agents of the two Governments." Bui the contested nationality was a consequence of the original outrage, not a cause. Had Kosta been an undisputed Austrian, the original crime and outrage involved in his seizure on Turkish soil by Austria, would have been as glaring and inexcusable as now. That seizure was as inexousably at war with International Law as that of the Duke d'Engbein, which Austria has vied with the rest of Christendom in stigmatizing as abhorrent. Let it not be forgotten that if Austria had not FIRST violated the right of sovereignty and the Laws.of Nations, she would have had nothing lo protest against. She planned and perpetrated a gross outrage, which resulted in her own humiliation, That is the case in a nutshell. How are protests to help her out of the pit she has dug and (alien into?
But American captains have no right to make war, or to disturb tho quiet and security of neutral ports." Of course not and if Turkey asks an apology from our Government for Capt. Ingraham's menaoed cannonade in the harbor of Smyrna, we trust one will be promptly tendered, and that it will be frank and ample. No nation more than ours should be ready and thorough in its recognition of the rights of nationality. But let tin Austrian national cruiser fire a broadside into an American National vessel, or seize a boat's crew of her men, and does Austria suppose that our oaptaiti would wait to send homo a report of the outrage and ask Congress to declare wart We affectionately advise all Austrian commanders not to be duped by this Protest into suposing that such is tho Yankee process in sudh cases made and provided? Whoever falls into so melancholy a delusion will be awakened by tho noise of something else than protocols, and hoar a new version of our National obligation read to him by a light which not even the dullest vision could resist.
The whole question, as between this country and Austria, turns on this point: Was the aot of Cspt. Ingraham aggressive or defensive! Did he commit an outrage, or only resist ono? On this question, we invoko the judgment of the civilized world.
We oouclude, therefore, that Kosta is entitled to the protection of the Unitod States that the Austrian officers committed a gross outrage, piraoy, and kidnapping of one in loco of nn American citizen that by tubsequent acts they persisted in and aggravated that outrage that Kosta must be surrendered with ample reparation that the laws of our citizenship must be established and resgected by the European powers, one and all and that the Administration of Gen, Pierce will not deoline "the responsibility."—Boston Post.
