After m»ifiy abortive efforts upon the ptrt of the whig* to head John Tyler, it teems he has at length succeeded in turning the very tables upon the whig party. We give the itorjr a* we hear It:

It aeemt (hat daring the last winter or spring.» country court in Mr Tyler's county, composed of several whig justices ol the peace, with a view to mortify and bumble Mr. Tyler lor his political sio ofturningdemocrat. appoiuted him overseer of a road, with the intention of enforcing the duties, or impose the fine in such-cases made and provided in that statute.

The lawn of Virginia, it seems, specifies no limited time for working oo sod repairing rosds. but its terms declare they shall be pur and kept in order. Accordingly. Mr Tyler being notified ot this new honor conferred, set about to discharge his duty. To the delight of his patron justices and whig brethren.be was very soon seen riding out through the peighborhood summoning the hands to work. The joke was too good to be lout, and many a whig countenance was lit up with smiles of the thought that the ex-Presi dent was at length harnessed with such mortifying duty. Old John, however, had too often dodged -their leaders to be beaded by the aujall fry. lie commenced his labors ss a faithful pub lie servant. The road being very undulating he determined to cut down the hills, fill up the gullies end ravines, and make it a good travel turnpike road. Day by day he plied himself to his work. The effect of his diligence was not only vissible on the old road but the neighboring farms began soon to show that just in proportion as the road succeed ed. fences, ditches, hedges, plowing, cart log and every other plantation service was neglected. For this there was no remedy The hands were all upon the road. The joke had become, in truth, a serions matter The smiles that lately illumed every countenance turned into ghastly dismay. A publio meeting of the whole neighborhood was called. Headed by the justices, they pro ceeded to the scene of operations, and beg get! Mr. Tyler for God's sake. forth*ir sake, and perhaps fore the sake of Ireland, to quit working on the road and let the hands go home. Mr. Tyler replied: *'That the law made it his duty to pnt the rood in good order and to keep it in such There was yet a good many bad hills to be cut down, and ravines to be filled, until that was done he fell it his bounden duty to work on. lie should dislike to be presented to the grand jury fot neglect of duty immediately alter his appointment."

•ays ihe heirs of Stephen Girard have commenced actions of ejectment in the Cir cuit Court and Court ol Nisi I'riua, against the immense estate bequeathed by the old ••mariner and merchant" to tho City Corporation, as trustees, 5tc. The present action is said to rest on ilia abolishment of the principle of entail, alleged to be violated in the present devise, which is perpetual and as Girard could not entail his estate in in his own family, howoould he entail it in a corporation? The case tnusi of ouree rest on legal principles, and if publio freedom is damaged, or wrong done to repub lican inatitutions by ihe Will, the sooner it is invalidated the better. The time is favorable to an impartial trial, for an intiiflerenoe, amounting to fcpathy on the subject, appears to pervade the public mind. Yet a judgment in favor of the heirs would obvioualy involve the oity to restitution, back rents, &c, in a frightful amount of dollars. The aotton is said to be timed within the twenty*one years' limit of actual prose«sion only by a few houra.
