MR. EDITOR —I wish 10 aay a few words to your readers in reference to the election of a Common Pleas Judge. There are now three candidates before the people, Judge Kinney,. Judge Lee, and Judge Jones, and I suppose every voter will inquire, who of those three is best qualified for the station. When he saiirfies himself in regard to that matter he should vote accordingly.
All three of the candidates are whig*, so that only the one question, that in reference to fitness and qualifications to discharge the duties of the office, need arise in reference to them. Politics** course can have nothing to do with the matter.
The Court of common Pleas, is anew Court created under our new Constitution. It has a more extensive jurisdiction given it, than was possessed by our old Probate Court, though it supercedes that Court. If the design of its creation is carried out, it may become the most important Court in the State.
The mere fact that it has probate jurisdiction makes it a very important Court, for probably the whole properly in the State passes, on an average, once in thirty years through its hands. Blunders committed in settling up estates, we all know, constantly give rise to very troublesome and expensive litigation. How important then that he before whom such business is transacted should be a men of abilities and thoroughly acquainted with the system of our our laws.
One great defect in the old Probate system was, that the office of Judge, giving no sufficient support, was never desired by men of any legal abilities or talents, It was consequently given to those, who were incompetent to discharge the duties prop* erly.
If any important legal question arose^therefore, a lawyer was either placed upon the JBench to instruct his Honor in matters of law, or else it was appealed to a higher Court. 1 have myself known the Probate Court, in this County, to delay business half an hour in order to hunt up a disinterested law yer to sit with the Judge.
It was sought to remedy this mischief by giving the Court a more extensive jurisdiction and affixing a salarv to the office of Judge. Shall we defeat the object of this change, and, by putting in the same order of men as before, make our new system as inefficient and as unsatisfactory as the former one?
No more important interests seek the protection of our Courts than those which belong to widows, and children. No more important and difficult branches of the luw exist than those which concern tho duties and relations of Executive and Administrators and Guardian and Ward, yet while you are careful that those who preside in other Court® are men of learning and standing as lawyers, you would place the administration of these branches of the law and the care of these interests into the hands of those, whom you would never think of calling upon to decide in rcfercnce to your ordinary rights.
Of the three candidates for tho office of Common Pleas Judge whose names are before the peo pie, Judge Kinney is the only one who is properly qualified for the office. He is a lawyer of fine legal attainment®, which no one doubts be has ex 4 pericnce ho has presided ably heretofore in the
Circuit Courts and he is a good man. Especially do we need such a man to preside in the Common Pleas Court, at a time, when auch a radical change in our system of practice and our laws of descents has just been ejected, and when wo all have to start out anew, without forms and old-established and well-known rules to guide us. 1 have no hesitation in saying that the office of Common Pleas Judge requires as accurate a knowledge of the law to discharge its duties properly, as does that of Circuit Judge. Taking this as a standard, can any one doubt, which candidate should receive the support of the voters of this county.

A mun with a broken watch would not go to a blacksmith to get it repaired nor would he seek out silversmith to shoe a horse, though each of these prrsoi.s might be perfect in his own trade. If thus in jour common business you seok tho services of those whose training has peculiarly fitted them to do certain things, why not in those matters which nfleet your legal rights act in the same sensible way?
I said before that our new Common Pleas Court miglii become the most important court in the State. If we have a Judge to preside in that court, whose knowledge of the law will enable us to place confidence in his decisions, it will be the court in which all the ordinary litigation of the country will be conducted, and our Circuit Court will only be called upon to entertain suits, in reference to matters, over which the Common Pleas Court has no jurisdiction. But, if otherwise, every oause, which can originally be brought in the Circuit Court will be brought there, and other oauses will be continually appealed. Thus tho advantages which were intended should accrue to suitors and to the country from the change which has been made, will bo entirely lost.
